Comcast Business Fee Class Action Lawsuit

Comcast business-class customers filed a class action lawsuit against the cable provider Friday alleging the company charged them early termination and Internet equipment fees in violation of their business agreements.
Plaintiffs allege in the Comcast fee class action lawsuit that Comcast Cable Communications Inc. breached its business service order agreements (“SOA”) by charging business customers excessive fees.
“Under the SOA and the terms and conditions, Comcast may only impose an [early termination fee] if a business-class customer cancels service prior to the end of the service term set out in a SOA that the customer signed,” the class action lawsuit states. “As such, Comcast has repeatedly breached its contracts with its business class customers by imposing an [early termination fee] on customers who attempted to cancel their business-class services after fulfilling their service term, when Comcast had auto-renewed their agreement, without the execution of a new SOA.”
The class action lawsuit further alleges the company improperly charges early termination fees to customers that must cancel business-class services when they move to new office locations outside of Comcast’s service area.
Comcast also allegedly increased the fees it charged for Internet equipment in violation of the SOA and Comcast’s own terms and conditions, according to the class action lawsuit.
The class action lawsuit is brought on behalf of all current and former Comcast business class customers who were charged an ETF or were threatened with an ETF charge after the expiration of the terms of services specified in their Service Orders and/or who, while still in their Service Terms, were charged Internet Equipment Fees higher than specified in their Service Orders.
The Comcast Business Fee Class Action Lawsuit case is Datascope Analytics LLC et al. v. Comcast Cable Communications Inc., Case No. 13-cv-608, U.S. District Court for the Eastern District of Pennsylvania.

Our small nonprofit is being charged for an additional 30 days after we discontinue service with Comcast business. We had to continue service until our business number (on all our signs and advertising information) was ported to our new service provider. Essentially they are making us pay for an additional 30 days and we don’t even have service with them any longer. We were not under contract. An incredibly deceptive business.
I would like to join the lawsuit. Comcast charged me as well as new house/ business owner I transferred the line. I could not get rid of contract with Comcast. Even after transferring the service to my house, I had to pay $199 as the contract is new for each address. It is not ethical.
Comcast Business Class is one of the most financial drain to our business (CPR EDUCATION AND SEMINARS, LLC). Our services were transferred to our new office location and services commenced on Aug 19, 2013. To this very date of November 21, 2013 the technicians have been here many times and our lines from local, toll free and fax have been down. We have lost volumes of calls = to decreased rev. They are not accountable. They don’t understand that non working lines is equivalent to loss of $$. This does not account for all the times I’ve waited for no show technicians and taking additional time to be present. The building that houses our offices hired their electrical engineers because Comcast blamed them. At a costly charge to our building managers. Evidentially it was a Comcast issue. I’ve been fighting with Comcast on many occassions and trust me I’ve tried the professional approach on several ocassions. I was so mad at their executive team for arrogance and ignorance that I almost blew a cerebral aneurysm. Their executive team kept referring to the phantom contract. I told them there is no contract initiated at the time of services three years ago. I have every email at the time I picked them for their so called superior business class. There is no signed contract that I ever signed or was advised by Nate Woodstra in Denver, Colorado. The SHI% show actually started then. I know this must be our time to hold them accountable.

While making inquiries into the high price of my bill this evening, I found that Comcast has been charging me higher rates as a business account for about 6 years. I have never been a business, yet they had my personal name listed under Business Name. I continue the be amazed at the audacity of this company.
I would join a lawsuit against Comcast as they sneakedly got us to sign a new renewal when we just wanted a wrongly assigned video charge removed from out billing (did not have TV or video use in office). They also have an agreement that says if you disconnect services in the initial service agreement you have to pay a large disconnect fee, but the initial is not longer in place so how can they charge an additional amount. They also will charge a two month fee (monthly bill) for not notifying them two months in advance of disconnection. What a fraudulent group!! All this is only posted on their website according to their customer service (which is so bad), they don’t give it to businesses at time of contract/signing.
