Class Action Settlement a Reminder of NY Mini Storage Property Rights

Extra Space StorageWhile California has some of the most stringent requirements regarding mini storage unit property seizures, there are similar standards for residents of New York City, which is why a proposed class action settlement regarding rule violations in the Golden State is important for New Yorkers.


Facility owners Storage USA and Extra Space Storage have not admitted to any wrongdoing in agreeing to the class action settlement, but if it is approved at an August 7 hearing, both companies will pay Class Members money if they were forced to pay excessive pre-foreclosure fees to avoid property seizures or if they were locked out of their storage unit if they were less than one month behind on their payments. Issues like these can often crop up in New York City as well.

In both locations, for example, storage unit owners must prepare a written document with the monthly rent and itemization of any potential charges. Renters must also receive a notice from facility owners of an enforcement of lien along with a demand for payment.

Many people may not realize that they are also able to appeal this action in front of a judge and should still have access to their personal property for a certain period pursuant to New York City statutes. California offers renters the ability to require a judicial hearing, but New Yorkers may file for these as well.

These strict requirements may afford renters opportunities to hold on to whatever items they have in storage prior to a property sale, especially if the company with which they have an agreement does not follow these steps.
