A new class action lawsuit accuses gambling company DraftKings of using misleading marketing to lure gamblers into placing bets.
A group of consumers claims DraftKings has a business model that pushes the boundaries of the law and misleads consumers and lures naïve gamblers into developing addictions, including by offering “risk-free” bet promotions.
“DraftKings uses these tactics to identify and cultivate the people it wants on its platform: those who are most susceptible to these sorts of promotions and most likely to lose a lot of money betting. In other words, marks,” the DraftKings class action says.
The group wants to represent multiple classes consisting of consumers both nationwide and from the state of Pennsylvania.
Class action claims DraftKings targets gambling addicts
The group argues DraftKings uses its user data to create profiles of users based on their demographic and financial information and betting behavior, then deploys targeted marketing to maximize the amount of money the users deposit and lose on its platforms.
The class action further alleges DraftKings targets people who are most susceptible to these sorts of promotions and most likely to lose a lot of money betting.
“The company frequently targets users that are on state self-exclusion lists for addicted gamblers or users who have directly asked the company to suspend or close their accounts to prevent them from continuing to gamble,” the DraftKings class action says.
The group claims DraftKings is guilty of negligence, failure to warn, conversion and intentional infliction of emotional distress, and of violating Pennsylvania’s Unfair Trade Practices and Consumer Protection Law.
The plaintiffs demand a jury trial and request declaratory and injunctive relief and an award of multiple, punitive, statutory and actual and/or compensatory damages for themselves and all class members.
A consumer filed a similar class action lawsuit against DraftKings last year over claims it misled consumers about the terms of a deposit bonus offer for its sports betting platform.
The company also agreed earlier this year to pay $10 million to put an end to claims it harmed consumers by selling non-fungible tokens (NFTs) on its now-defunct DraftKings Marketplace.

I have been looking for any type of answers, if a lawyer would like to see manipulation and unethical marketing from these casinos I will be glad to show pictures, receipts and emails that are unbelievable. I have lost my self to this, I live in Michigan and have been hurt beyond recognition emotionally, mentally and financially. My company, my life and my family now pay the price for my unexplainable condition of loss due to these persuasive actions by manipulation tactics of these companies. To have your lively hood ripped from you unknowingly blinded by uncontrollable play ignited by false and exaggerated VIP promotions, free bets, free play and much more all to brainwash me and many other individuals. Enough is enough they should and need to be held accountable for the thefts of psychological behavior and the loss of freewill!
If any possibility I would like for a representative to look at my case I believe I am a strong individual with lots of facts and evidence of their wrongdoing.
This site has been so manipulating they get you hooked with deals and offers that are always less or different then they say. As soon as you start to back off and not spend so much they start spamming your email with offers.. or give you the vip trial run. Where u have to spend an obnoxious amount to try to stay in the running for a vip host that never comes. Then the glitches you can have screen shots proving they ripped you off and you try to talk to them about it and they ghost you when they don’t like what ur saying. This site is horrible and yet I still to this day have it cause they got me hook line and sinker.. sinker being the key word.. I’ve lost more money on this app than I make. I’ve ruined so much and I still can’t get off it.. crazy I have other casino apps on my phone but this is the only one I feel I have to constantly check and try

I have the DraftKings app on my phone and have used it to place bets during football seasons.
My names Eric baumert, ive used draftkings since launch, signed up due to there deposit offer. I began betting more and more money, they starting offering deposit match bonuses frequently. I started off betting a smaller amounts and now bet more then I wver wanted to. I think I’d be a good fit for this lawsuit . I’ve used other sportbettong sites also.
