MSI has been hit with a class action lawsuit alleging that many of its laptops have defective hinges that prematurely crack and break.
Plaintiff Dylan Bashaw and two others filed the class action lawsuit against MSI Computer on Aug. 1 in New York federal court, alleging violations of state and federal consumer laws.
According to the lawsuit, MSI sold laptops with defective hinges that crack and break prematurely, rendering the devices unusable. The plaintiffs claim that the defect is a result of poor design and materials and that MSI has failed to address the issue despite being aware of it.
The lawsuit alleges that the defect affects various models of MSI laptops, including the G series, Prestige, Creator, Stealth, Summit, Katana and Delta lines. The plaintiffs claim that the laptops are “doomed to fail” after a short number of open-close cycles due to the use of fragile plastic mounting points to connect the hinge anchors to the interior of the top case.
The lawsuit alleges that MSI’s use of overly tight hinge joints and failure to ensure that hinge screws are uniformly tightened accelerates the deterioration of the plastic mounting points. As a result, the hinges detach from the top case, causing damage to other components of the laptop, such as the plastic casing, screen bezel and display.
Plaintiffs say MSI refused to repair laptops
The plaintiffs allege that MSI has been aware of the defect for years, based on its own quality control and internal testing, repair and warranty data and customer complaints. Despite this knowledge, the plaintiffs claim that MSI has refused to repair or replace damaged laptops without charge, even within the warranty period.
The lawsuit accuses MSI of concealing the defect from consumers and failing to disclose it in its marketing materials. The plaintiffs allege that MSI represented the laptops as durable and portable, with some models advertised as having “military-grade durability.”
The plaintiffs claim that they relied on these representations when purchasing their laptops and would have paid less or not purchased them at all if they had known about the defect.
The plaintiffs seek to represent a class of all purchasers of the affected MSI laptops in the United States. They are suing for violations of the New York General Business Law, breach of express and implied warranties, fraudulent concealment and unjust enrichment. They are seeking damages, restitution, and injunctive relief.
In 2024, a computer owner sued Intel alleging it produced defective 13th- and 14th-generation processors that are unstable and prone to frequent crashes.
