A new class action lawsuit accuses Kohler Co. of failing to abide by consumers’ requests to reject cookies on its websites.
Plaintiff Martin Beltran filed the class action complaint against Kohler on Nov. 8 in California federal court, alleging violations of state privacy laws.
According to the lawsuit, Kohler’s websites — kohler.com, robern.com and kallista.com — display cookie consent banners that give users the option to “Reject All” cookies. However, Beltran alleges that even after users select this option, Kohler still allows third-party companies to place cookies on their devices and track their browsing activities.
“Kohler’s promises are outright lies, designed to lull users into a false sense of security,” the class action lawsuit says.
The class action alleges that Kohler’s websites use cookies from companies like Meta (Facebook), ByteDance (TikTok) and Microsoft, which track users’ browsing history, visit history, website interactions and other personal data. This data is then used by these third-party companies for targeted advertising and marketing analytics, the class action lawsuit states.
Kohler’s actions violate California privacy laws, including the California Invasion of Privacy Act, the lawsuit claims.
Kohler class action: Company’s actions ‘egregious’
The lawsuit claims Kohler’s actions are “egregious” and constitute a “total breach of consumer trust.” Beltran says he visited Kohler’s website to learn about its products and, like many users, opted to reject all cookies. However, he alleges his browsing activities were still tracked and shared with third parties.
The lawsuit seeks to represent all individuals who browsed any of Kohler’s websites in California after clicking the “Reject All” button on the cookie consent banner. Beltran is suing for invasion of privacy, intrusion upon seclusion, wiretapping and other violations of California law. He seeks certification of the class action, damages, fees, costs and a jury trial.
Meanwhile, Skechers USA is also facing a class action lawsuit claiming it uses tracking software to monitor shoppers’ online activity without their consent.
