InSinkErator class action overview:

  • Who: Two consumers filed a class action lawsuit against InSinkErator LLC.

InSinkErator is facing a class action lawsuit alleging its garbage disposals prematurely fail due to a defect that causes them to rust and corrode.

Plaintiffs Thomas Cohen and Erik Paulsen filed the class action complaint against InSinkErator on Dec. 16 in California federal court, alleging violations of state and federal consumer laws.

According to the class action lawsuit, InSinkErator designed, manufactured and sold garbage disposals containing galvanized steel, which the company allegedly knew was not suitable for long-term use due to corrosion.

The plaintiffs claim the company concealed the unsuitability of its design from consumers, leading to premature failures and significant water damage in many cases.

They allege they and other consumers were deceived by InSinkErator and had garbage disposals that not only prematurely failed but frequently resulted in significant water damage to their cabinetry and kitchens.

The plaintiffs claim they would not have purchased the garbage disposals or would not have paid as much for them if they had known the truth about the use of galvanized steel in garbage disposals.

InSinkErator allegedly knew its garbage disposals were not durable 

According to the class action lawsuit, InSinkErator claims to be “the world’s largest manufacturer of garbage disposals and instant hot water dispensers for home and commercial use.” However,  while the company marketed its products as “durable” and “long-lasting,” the plaintiffs claim that internal documents reveal InSinkErator knew its products were not as reliable as advertised.

They allege the company relied heavily on its brand recognition to sell its products and used misleading representations about the durability of its disposals.

The class action lawsuit further alleges that InSinkErator’s warranty terms do not adequately cover the corrosion issues. The plaintiffs claim the company’s warranty communications misled consumers into believing that rust was only cosmetic and would not affect the product’s performance.

The plaintiffs say they seek to represent anyone in the United States or California who purchased an InSinkErator garbage disposal manufactured on or after Dec. 15, 2018.

They are suing for breach of warranty, fraudulent concealment and violations of California’s consumer protection laws and are seeking certification of the class action, damages, fees, costs and a jury trial.

Meanwhile, a wave of lawsuits nationwide allege defective designs, premature failures and misleading sales practices involving products such as refrigerators, washing machines, dishwashers and other household appliances.
