A new class action lawsuit alleges V Shred misleads consumers by advertising fake sales.
Plaintiff Josh Goldman filed the class action lawsuit against V Shred on July 18 in California federal court, alleging violations of state and federal consumer laws.
V Shred is a company that sells online fitness programs, diet programs and supplements. The company advertises its products at discounted prices on its websites, but the discounts are fake, Goldman alleges.
He claims V Shred never sells its products at the regular prices that it advertises, and the discounts are always available.
“V Shred tricks consumers into thinking they are getting a discount when they are really just paying the regular price,” the V Shred class action says.
V Shred’s fake discounts violate California’s consumer protection laws, which prohibit businesses from advertising discounts that are not genuine, the lawsuit argues.
The Federal Trade Commission also has regulations against false or misleading “former price comparisons,” which the lawsuit claims V Shred violates.
V Shred’s fake discounts create sense of urgency for consumers, class action claims
Goldman explains V Shred’s fake discounts create a sense of urgency for consumers, who believe they are getting a good deal and may be more likely to buy the products.
The discounts also create a false sense of value, as consumers believe they are getting a product that is worth more than they are paying for, the lawsuit says.
Goldman says he purchased a V Shred product in April 2024, believing he was getting a discount. He argues he would not have purchased the product if he had known the discount was fake.
He is looking to represent anyone in California who purchased one or more V Shred products advertised at a discount on the company’s websites.
Goldman is suing for violations of California’s False Advertising Law, the Consumers Legal Remedies Act, the Unfair Competition Law, breach of contract and warranties, unjust enrichment and negligent and intentional misrepresentation. He is seeking certification of the class action, damages, restitution, disgorgement, injunctive relief, fees, costs and a jury trial.
Meanwhile, V Shred recently agreed to pay $4 million to settle a class action lawsuit alleging it violated privacy laws by sharing personal information with third parties without consent.
