A new class action lawsuit alleges Bissell Homecare starts the warranty period for its products on the date of purchase rather than the date of delivery.
Plaintiff Todd Albrigo filed the class action complaint against Bissell Homecare on June 2 in California federal court, alleging violations of California’s Song-Beverly Consumer Warranty Act (SBA) and the state’s Unfair Competition Law (UCL).
Albrigo claims Bissell’s alleged failure to start its warranties on the date of delivery results in consumers who receive their goods after the date of purchase, such as online shoppers, not receiving the full benefit of their warranty.
“These consumers are short-changed the full value of their warranties,” the Bissell class action claims.
Albrigo argues Bissell benefits by saving itself the added time and expense that would be required to properly track and administer its warranties if they were to commence on the date of delivery.
Bissell’s warranty policy is ‘unlawful,’ class action says
Albrigo wants to represent a California class of consumers who purchased one or more of Bissell’s products between July 1, 2023, through the date of class certification, whose products were delivered to them after the date of purchase.
The plaintiff demands a jury trial and requests declaratory and injunctive relief, as well as an award of restitution and disgorgement and statutory and punitive damages for himself and all class members.
“Defendant has a uniform warranty policy where warranties are all commenced on the date of purchase rather than the date of delivery or receipt of the products,” the Bissell class action says.
Albrigo argues Bissell’s alleged failure to start its warranties on the date of delivery “creates a chilling effect” that prevents consumers who would otherwise have valid warranty claims from pursuing them.
In May, a class action lawsuit filed in California federal court alleges that LG Electronics shortchanged consumers by starting product warranties at the purchase date rather than the delivery date.
