A new class action lawsuit filed against The PNC Financial Services Group accuses the financial services company of wiretapping the electronic communications of visitors to its website without their knowledge or consent.

Plaintiff Leslie Birdsall claims PNC intercepts and records the electronic communications of visitors to its website through a tracking technology provided by LinkedIn.

Birdsall argues PNC uses LinkedIn’s tracking technology to collect and analyze how individuals interact with its website, including its subpages. The plaintiff claims LinkedIn’s tracking technology captures and stores the website communications of each visitor to PNC’s website.

“Defendant knowingly, willfully and intentionally procured the interception of, and used, the electronic communications at issue without the knowledge or prior consent of Plaintiff or the Class Members,” the PNC class action lawsuit says.

PNC class action lawsuit claims company violated state privacy law

Birdsall wants to represent a Pennsylvania class of consumers who had their electronic communications intercepted through the use of LinkedIn’s tracking technology embedded on PNC’s website.

The PNC class action lawsuit alleges the financial services company violated the Pennsylvania Wiretap Act and is guilty of invasion of privacy.

Birdsall demands a jury trial and requests declaratory and injunctive relief and an award of actual, statutory, compensatory, consequential, punitive and nominal damages for herself and all class members.

In 2024, PNC faced a class action lawsuit alleging the company exploited its retirement account investors for its own financial gain.
