Modern Gents class action lawsuit overview:

A new class action lawsuit alleges jewelry company Modern Gents advertises fake discounts to consumers.

Plaintiff Britni Warner claims Modern Gents advertises fake discounts for its jewelry products on its website by listing misleading regular prices in strikethrough font.

“Defendant creates the false impression that its Products’ regular prices are higher than they truly are,” the Modern Gents class action lawsuit says.

Warner argues that Modern Gents’ website also offers additional supposed discounts on top of the misleading strikethrough prices, such as 25% off sitewide.

“Defendant’s website persistently offers ‘X% off’ sitewide,” the Modern Gents class action lawsuit says. “Reasonable consumers reasonably interpret Defendant’s advertisements to mean that they will be getting a discount ‘off’ of the prices that Defendant usually charges for its Products.”

Warner wants to represent a nationwide class and California subclass of consumers who purchased one or more Modern Gents products advertised at a discount on the company’s website during the applicable statute of limitations period.

Modern Gents’ advertisements harm consumers, class action says

Warner claims Modern Gents’ advertisements harm consumers by inducing them to make purchases based on false information.

“Defendant’s advertisements artificially increase consumer demand for Defendant’s Products,” the Modern Gents class action lawsuit says. “This puts upward pressure on the prices that Defendant can charge for its Products.”

The Modern Gents class action raises claims for breach of contract and express warranty, negligent and intentional misrepresentation, quasi-contract/unjust enrichment and for violations of California’s Unfair Competition Law, False Advertising Law and Consumer Legal Remedies Act.

Warner demands a jury trial and requests declaratory and injunctive relief and an award of damages for herself and all class members.

Similarly, Kendra Scott LLC faced a class action lawsuit accusing the company of advertising fictitious regular prices and corresponding phantom discounts on products sold through its website.
