wage and hour overtime nursesA CareMeridian employee filed a California overtime class action lawsuit against her employer, claiming it failed to follow basic federal and state labor laws.

The plaintiff, McKenzie E., worked for CareMeridian as a Registered Nurse for about a year, from August 2016 to July 2017. In this position, she as classified as non-exempt on hourly pay, and was entitled to the benefits that federal and state labor laws provide, including overtime wages and proper meal and rest breaks.

According to the California overtime class action lawsuit, CareMeridian failed to accurately record and pay McKenzie and others in her position, including discrepancies with overtime pay. Indeed, McKenzie claims these workers were required to work off the clock because they were not allowed enough paid labor hours to complete all the tasks required of them. Employees therefore lost out on overtime wages that were owed for the off the clock time they worked.

The California overtime class action lawsuit was filed on multiple counts, including unlawful business practices, failure to pay overtime compensation, failure to provide required meal periods and rest periods, failure to provide accurate itemized statements, failure to pay wages when due, and failure to reimburse employees for required expenses.

McKenzie brought this California overtime class action lawsuit forward on behalf of herself and all others in a similar situation with CareMeridian. Employees and former employees eligible to join the California overtime class action lawsuit are those non-exempt workers in the period four years prior to the filing of the complaint.

CareMeridian is a facility that provides healthcare recovery services to patients suffering from serious conditions like traumatic brain or spinal cord injuries.

The California overtime class action lawsuit was filed in the California Superior Court on Sept. 6, 2017.

Wage and Hour Regulations

There are a series of both federal and state wage and hour laws put in place to protect workers and ensure they are treated fairly. However, many workers do not know the protections that the Fair Labor Standards Act (FLSA) and California labor laws offer, which can lead to employers taking advantage of them, in some cases requiring unpaid overtime work despite the illegality of doing so.

Some workers may find themselves unable to file wage and hour complaints like this unpaid overtime lawsuit because they are not aware of FLSA rules. Others may be afraid that their employers will retaliate or even fire them if they speak up about these kinds of FLSA violations. To protect workers who help to enforce FLSA rules, laws also exist to protect workers from discrimination based on wage and hour complaints.
