If you received a call from a British Airways contact number, your call may have been recorded in violation of California call recording laws.

California residents who call or receive calls from certain businesses may be eligible for legal action due to allegations that the companies may be recording calls without consent. Although no company-specific allegations have been made, businesses under investigation include British Airways, Czech Airlines, Dermalogica, Fisher & Paykel, Harman Audio, Hunter Boots, JBL Audio, Malaysia Airlines, Tupperware, and Romano’s Macaroni Grill.

Should an investigation find that these companies, or others, have been recording calls without consent, consumers who received a call from a British Airways contact number or another toll free business number may be able to file a lawsuit against the companies for violating California privacy laws.

California considers right to privacy an inalienable right and therefore has the strictest privacy laws in the country, supported by their state constitution. In 1967, the state passed the California Invasion of Privacy Act which protects California citizens from invasion of privacy via technology. Under this act, California citizens are protected from privacy breaches online, in person, and through technology.

California business call recording laws prohibit any person or business to record telephone calls without the consent of all parties participating in the call. California call recording statutes forbid “maliciously and without the consent of all parties to the communication, [intercepting], [receiving], or [assisting] in intercepting or receiving a communication transmitted between cellular radio telephones or between any cellular radio telephone and a landline telephone”. Similar statutes are in place for communication between other telephone devices.

If consumers received calls from a toll free number, such as a British Airways contact number, and did not receive a warning that their call was recorded, their call may have been recorded without consent. Under California law, businesses are required to disclose if they are recording calls at the immediate start of the call. Generally speaking, staying on the line after a call recording message is considered consenting to have the call recorded.

When faced with legal action over call recording, businesses often claim that recording calls are for training purposes or improving customer service. However, recording calls without consent can be illegal regardless of the recorder’s intent.

Consumers who received calls from a British Airways contact number, or another toll free business number, may be able to file a call recording lawsuit if they believe their calls were recorded. Should a call recording lawsuit find that businesses recorded calls without consent, they may have to pay damages up to $5,000 per violation per plaintiff, or three times the amount of damages suffered.

Instead of risking the costs of litigation and the exorbitant compensatory and punitive damages, businesses may choose to settle lawsuits before going to trial. Several businesses have already paid millions of dollars to settle call recording lawsuits alleging violations of California privacy laws.
