A new class action lawsuit alleges Zuru LLC fails to disclose that some of its Bunch O Balloons products contain toxic chemicals that could pose health risks to users, including children.
Plaintiff Leyth Dauod claims Zuru failed to warn consumers about the presence of organic fluorine in its Bunch O Balloons Self-Sealing Water Balloons, which he argues could lead to potential health risks.
Dauod claims Zuru’s omission of this information misled consumers into believing they were purchasing a safe and environmentally friendly product.
“The products are particularly concerning given water balloons are marketed to and used by children; and upon being thrown, water balloons leave behind latex fragments that leach chemicals into the surrounding environment,” the lawsuit states.
Zuru misled consumers into thinking Bunch O Balloons were safe, class action alleges
Dauod claims Zuru marketed its Bunch O Balloons product as sustainable and environmentally friendly, emphasizing that the balloons are made from natural rubber latex and that the stems can be easily recycled.
However, the plaintiff argues that Zuru failed to disclose the presence of organic fluorine, which he claims is an indicator of per- and polyfluoroalkyl substances (PFAS), commonly known as “forever chemicals” due to their persistence in the environment and human body.
Dauod claims he commissioned independent third-party testing on Bunch O Balloons that revealed the presence of organic fluorine at levels exceeding California’s legal limits for consumer products.
He argues that the presence of PFAS in the balloons contradicts Zuru’s marketing claims and poses a health risk, particularly to children who are the primary users of the product.
Dauod claims he purchased Bunch O Balloons multiple times and relied on Zuru’s marketing, which he says led him to believe the product was safe and environmentally friendly.
The plaintiff argues Zuru is guilty of violating California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act.
He is looking to represent a California class of consumers who purchased Bunch O Balloons from Zuru over the last four years, and he is seeking certification of the class action, damages, fees, costs and a jury trial.
