Brett Bros. “Performance Jewelry” Class Action Lawsuit

A class action lawsuit resembling the one that nearly took down the Power Balance bracelet franchise last year has been filed against Brett Bros. Sports International over its so-called “performance jewelry.”
Plaintiff Seth Thompson of Iowa claims in the class action lawsuit that Brett Bros. Sports International, led by Royals legend George Brett, misrepresented how its necklaces and other accessories could improve the wearer’s sports performance, which the company says can “help relieve stiffness in the shoulders and neck, eventually stabilizing your whole body, as well as help recovery from sports fatigue, restore important ion balance, and improve concentration and focus.”
“Most consumers, when reading these claims, and seeing the products endorsed by a high-profile baseball player, assume that these products have the health benefits that are marketed and advertised and that scientifically significant research supports statements made by Brett Bros., when in fact that is not the case,” the Brett Bros. class action lawsuit states.
Thompson says he purchased a Brett Bros. Ionic necklace for around $30 at the 2011 College World Series and “hoped to experience the increased energy and focus and reduced fatigue and stress that the Brett Bros. website described.” Instead, he “used the Brett Bros. necklace as instructed and advertised, but did not experience any of the promised benefits,” the class action lawsuit states.
The Brett Bros. class action lawsuit is brought on behalf of anyone who bought one or more Brett Bros. accessories within the last four years. It is seeking damages, disgorgement of the proceeds and an injunction barring Brett Bros. from further false marketing.
