Boston-Scientific-mesh-lawsuit

A woman has filed a lawsuit against a product manufacturer after having problems related to her pelvic mesh.

Plaintiff Jeanette P. filed a Boston Scientific mesh lawsuit in U.S. District Court for the Southern District of West Virginia on June 7, 2017.

Jeanette P., a citizen of the State of Colorado, had a Boston Scientific product known as the Advantage Transvaginal Mid-Urethral Sling System implanted on June 19, 2007, just under ten years earlier.

According to legal short-form documentation, the plaintiff had the product implanted by Dr. Nancy Germer at Swedish Medical Center in Englewood, Colo.

Jeanette P. brings this Boston Scientific mesh lawsuit against the corporation as part of multidistrict legislation (MDL) 2326, a pelvic repair system products liability lawsuit.

The Advantage Transvaginal Mid-Urethral Sling System is one of several mesh products listed in MDL 2326 put on the market by Boston Scientific.

It is specifically used to treat a condition known as Stress Urinary Incontinence (SUI). Other mesh products listed also treat this condition or another condition called Pelvic Organ Prolapse (POP).

According to the MDL long form complaint relevant to this Boston Scientific mesh lawsuit, the mid-urethral sling system and other mesh products manufactured by this corporation are made of polypropylene and collagen.

In the factual background section of the legal documentation, it is stated that polypropylene is “incompatible with human tissue.” A large number of recipients of products containing polypropylene report experiencing an immune response to the presence of this substance, which leads to inflammation and pain in the pelvic cavity.

Collagen is also a material ingredient in some mesh SUI and POP remedy products. Collagen is created from animal and human tissue, and it can cause a harsh reaction in the female pelvic area.

Collagen, while it is meant to disappear and be absorbed after a period of time, can be treated by the body as a foreign agent and spark an immune response leading to infection, pain, and a lack of functionality.

According to the documentation specific to this case, the plaintiff is bringing the following counts against the defendants in this Boston Scientific mesh lawsuit: negligence, strict liability for design defect, manufacturing defect and failure to warn, breach of express warranty, breach of implied warranty, and fraudulent concealment.

Jeanette P. is asking for punitive damages, compensatory damages, restitution of all funds acquired as a result of the defendant’s willful misconduct, and all costs associated with the legal process of adjudicating the lawsuit such as attorney’s fees and court costs. She seeks a trial by jury.

The Boston Scientific Mesh Lawsuit is Case No. 2:17-cv-03212, in the U.S. District Court for the Southern District of West Virginia.
