Boot Man, also known as Premier Parking Enforcement, agreed to a class action lawsuit settlement to resolve illegal booting claims.

The settlement benefits individuals who had a vehicle booted by Boot Man or paid for a boot to be removed by Boot Man in Atlanta between Aug. 9, 2012, and Dec. 31, 2018.

Boot Man Inc. is a parking enforcement company that boots vehicles in violation of parking rules. Numerous negative reviews on the Better Business Bureau website resulted in an “F” rating for the company. Reviewers say their vehicles were wrongfully booted by Boot Man despite the vehicle owners not violating any parking laws.

After facing similar treatment, some drivers took legal action in a class action lawsuit. According to plaintiffs in the case, the company regularly boots vehicles despite drivers adhering to all applicable parking laws. 

Booting occurs when a parking company puts a metal “boot” on a vehicle’s wheel that prevents it from moving. Boots must be removed from vehicles in order for vehicles to operate, meaning that drivers are at the mercy of booting companies to remove boots from their vehicles. The defendant allegedly uses illegal booting to leverage large payments from drivers.

Other companies have faced similar allegations in Georgia. This year, Castle Parking Solutions agreed to pay $3.5 million to resolve claims it illegally booted vehicles in Atlanta and Decatur, Georgia. Castle Parking also was accused of booting vehicles to collect large payments from drivers.

Under the terms of the booting settlement, class members may be eligible for a cash payment. 

Settlement benefits will vary depending on the number of claims submitted and the net settlement fund amount after fees and costs are deducted. According to the settlement website, payments will be no more than $30 per class member.

The deadline for exclusion and objection is Sept. 26, 2022. 

The final approval hearing for the booting class action settlement is scheduled for Oct. 26, 2022.

In order to receive a payment from the booting class action settlement, class members must submit a valid claim form by Sept. 26, 2022. Class members should include any documentation they have to prove their vehicle was booted by Boot Man or that they paid to have a boot removed during the class period.

• The vehicle that was booted by Boot Man;
• Where and when the booting occurred;
• That you were driving the vehicle that was booted; and
• That you made payment to Boot Man to have the boot removed (i.e., receipts, credit card statements).
