A new class action lawsuit alleges Boiron’s website shares users’ personal information with TikTok without their consent.
Plaintiff Miltita Casillas filed the class action lawsuit against Boiron, which sells homeopathic medicinal remedies, on March 14 in a California state court, alleging violations of the California Invasion of Privacy Act (CIPA).
According to Casillas, Boiron’s website, boironusa.com, hosts invasive tracking and surveillance software created by TikTok’s parent company, ByteDance, which collects users’ personal information without their consent.
“Defendant falsely promised Website visitors that it would protect their privacy, but then secretly monetized their personal information by enabling TikTok to spy on those visitors, surveil their journey across the web, track their location and lifestyle habits and bombard them with targeted advertising,” the Boiron class action lawsuit states.
Boiron is a Pennsylvania-based homeopathic remedy company that operates the website boironusa.com to communicate with potential customers, Casillas explains.
She claims Boiron assures website visitors that it only collects personally identifiable information when voluntarily provided, but in reality, the company allegedly allows TikTok to surveil website interactions and create detailed profiles of visitors’ interests and needs.

Casillas claims Boiron’s website uses TikTok’s software to secretly collect users’ device and browser information, geographic data and other identifying details without consent.
She alleges that the software begins collecting information as soon as users land on the website, before any pop-up or cookie banner seeks their consent.
The Boiron class action lawsuit argues that this secret data collection violates California’s Trap and Trace Law, which prohibits the use of devices or processes that capture identifying information without a court order.
Casillas is looking to represent anyone in California whose personal information was shared with TikTok or other third parties by Boiron without their effective and informed prior consent.
She is suing for violations of the CIPA and seeks certification of the Boiron class action, damages, fees, costs and a jury trial.
In 2019, users filed a class action lawsuit against TikTok, alleging the popular app accumulates data and transfers that information to servers in China. This information can reportedly be used to identify and track the location of users within the United States.
