Abbott Laboratories agreed to a $19.5 million class action lawsuit settlement to resolve claims its Similac infant formula doesn’t make as many servings per package as promised on labels. No proof of purchase is required for consumers to benefit.

The settlement benefits consumers who purchased various Similac products between June 24, 2016, and Sept. 22, 2022. The settlement covers a number of Similac product lines such as Advance, Sensitive, Total Comfort and Organic. A full list of covered products is available on the settlement website.

Similac is an infant formula brand that offers a number of product lines designed to meet newborns’ nutrition needs. Similac manufacturer Abbott has been linked to the nationwide baby formula shortage after a whistleblower’s lawsuit forced the company to close the nation’s largest baby formula factory.

According to a class action lawsuit, Abbott falsely advertises its Similac products as able to make more servings of formula than is accurate. Even when following the provided instructions, the products allegedly fail to make the number of servings advertised on labels.

Consumers say they wouldn’t have purchased the items or paid as much for the products if they knew they wouldn’t get the promised number of formula servings. Plaintiffs in the baby formula class action lawsuit sought financial compensation for the injuries caused by the alleged false advertising.

Abbott Laboratories hasn’t admitted any wrongdoing but agreed to a $19.5 million class action settlement to resolve these claims. PBM Nutritionals and Mead Johnson & Co. agreed to similar settlements this year.

Under the terms of the Similac settlement, class members can receive up to $3 per purchased unit. Class members who can provide proof of purchase can claim up to 15 units for a maximum payment of $45. Consumers without proof of purchase can claim up to five products for a maximum payment of $15. Only one claim may be made per household.

Abbott agreed to either remove the challenged label language or revise it so the amount of servings advertised per package accurately reflects the product contents. These changes will go into effect six months after the court’s final settlement approval order and must remain in place for at least three years after final approval. 

The deadline for exclusion and objection is Dec. 14, 2023. 

The final approval hearing for the Similac settlement is scheduled for Dec. 29, 2022.

In order to receive settlement benefits, class members must submit a valid claim form by Jan. 31, 2023.
