Two Avis Budget car rental employees have reached a settlement agreement with the rental car company over allegations that they were misclassified as supervisors under the Fair Labor Standards Act.
Both Erica Johnson and Jose Santiago alleged in the Avis class action lawsuit that while both of their job titles were that of a supervisor, only a small minority of their time was spend directing the work of others, and that they had therefore missed out on wages and unpaid overtime for all hours they worked in excess of 40 hours. Johnson and Santiago did not motion for certification of the case and motioned to have it dismissed on March 18 after they reached an undisclosed settlement agreement with Avis Budget Car Rental.
While the terms of the Avis overtime settlement were not publicized, the plaintiffs called the agreement, which provides back wages, a “reasonable compromise” and “objectively fair” to the Avis car rental employees.
The Avis Overtime Class Action Lawsuit is Erica Johnson, et al. v. Avis Budget Car Rental LLC, et al., Case No. 13-cv-11796, in the U.S. District Court for the District of Massachusetts.
While that case is resolved, a similar class action lawsuit filed in Florida federal court is moving ahead after a judge there approved class certification. In the decision, the judge decided that the rental car company could not uniformly describe that group of employees as a “supervisor” class and then go back and argue they should have different claims because their duties may have subtle differences.
