ATI Window Product Class Action Settlement

California property owners with ATI Windows manufactured within the past 11 years may be able to claim up to $200 or more from a class action lawsuit settlement with ATI.

According to the ATI Window Product class action lawsuit, entitled Melnick, et al. v. Aluminum Technology, Inc., several ATI Window products manufactured since 1995 contain defects that allow water to seep in and cause damage to the interior still or jamb reveal.

You’re considered a class member of the ATI window settlement and eligible for benefits if you’re a current California homeowner whose building presently contains an ATI Window product manufactured from 1995 through the present.

Here are the class action settlement benefits you can claim:

(I) The “Liquidated Payment Option.” In lieu of the right to receive compensation on a Per Window Compensation basis, you may elect to receive a lump sum cash payment of $200. Only one $200 Liquidated Payment will be available for each home that contains an ATI Window Product.

(II) The “Per Window” Compensation Option. Under this option, you may apply for compensation of $50 per Window Product. To claim this option, you must provide evidence of (1) a “water stain” to the finished surface of the interior sill or jamb reveal; (2) blistering, peeling flaking or spider web cracking of the paint or finished surface of the sill or jamb reveal that can be repaired by sanding and re-painting; or (3) evidence of deterioration, decay to the interior still or jamb reveal or other “loss of integrity” in the form of swelling, warping, softened or crumbling of the material, excluding its finished surface.

To claim your cash money from the ATI Window class action settlement, you must submit a valid claim form and any supporting documents, if necessary, by May 5, 2011.
