ASUS Computer International Inc. and Best Buy Stores LP face a computer fire lawsuit filed by a woman acting as a personal representative of a loved one.
Plaintiff Stacia T. files the computer fire lawsuit on behalf of the estate of Linda C., now deceased, in Arkansas federal court. The lawsuit was filed on May 7, 2018.
According to the computer fire lawsuit, Linda passed away from a fire at her house that resulted from a fire caused by a laptop computer purchased from Best Buy and manufactured by ASUS. Stacia says that Linda and her family used the computer in a โreasonable and expected manner.โ
However, on the evening of Nov. 12, 2017 and while Linda was sleeping, Stacia says โthe Computer burst into flames and caughtโฆ [Lindaโs] home on fire.โ She passed away from the fire, and significant property damage was suffered including market value losses.
The computer fire lawsuit was filed on multiple counts including negligence, Violation of Arkansas Deceptive Trade Practices Act, and strict liability.
A jury trial is demanded.
Overview: Filing a Furniture Appliance Injury Lawsuit
In many cases, the companies that manufacture and design the products, furniture, and appliance are held responsible for causing consumer injuries and in some cases, death.
In fact, a report was issued by the Consumer Product Safety Commission (CPSC) in 2016. According to the report, they found that each year more than 30,000 Americans pay visits to ER rooms throughout hospitals over injuries caused from appliances, TVs, and furniture. As a result of appliance accidents, nearly 500 people have died between 2000 and 2015.
An โAnchor Itโ campaign was also launched by CPSC in 2015. The campaign was initiated to help educate the public and โprevent furniture and TV tip-overs from killing and seriously injuring children.โ Parents are asked to make sure that their appliances and furniture are not under a tipping recall and that TVs are mounted using anchors as well.
The CPSC estimates that every 30 minutes a child is sent to the emergency room because of injuries suffered from falling TV. Every ten days, a child is also killed because of a falling TV, the CPSC states. It is also maintained that the advent of flat screen TVs have also caused an increase in the number of TV injuries. One of these reasons includes the top-heavy design of the TV, which allows them to be pulled on by a child or bumped. Anchoring is said to be the best way to prevent a TV from falling and causing unnecessary injuries and damages.
