A Michigan woman recently filed an ASR hip replacement lawsuit against DePuy, alleging the device was defective and caused serious injuries.
The plaintiff, Betty F., was implanted with a DePuy ASR hip implant in her right hip on Nov. 3, 2009. Unfortunately, sometime after the implantation, Betty began suffering serious complications that she alleges were directly caused by the defective hip implant device.
According to the ASR hip replacement lawsuit, these injuries include “pain and suffering, grinding of her hip joint, clicking, popping, pain, difficulty walking, instability, physical limitations, infection, and an inability to engage in her usual social and recreational activities, lost wages, medical expenses, elevated cobalt and chromium levels in her blood, and permanent disability and disfigurement.”
These injuries were serious enough that Betty had to have the device removed on March 1, 2017. But some of her injuries continue to persist, she claims. The removal surgery, of course, brought new risks as well as medical expenses to the table.
Betty’s ASR hip replacement lawsuit was filed on Sept. 12 in the U.S. District Court for the Western Division of the Northern District of Ohio. She filed the ASR hip replacement lawsuit on multiple counts, including negligence, breach of implied warranties, fraudulent misrepresentation and concealment, and negligent misrepresentation.
In filing her ASR hip replacement lawsuit, Betty hopes to receive both compensatory and punitive damages, medical monitoring, and costs of the suit.
The DePuy ASR Hip Implant
Hip replacement surgery is one of the most common surgical procedures—each year, thousands of Americans are implanted with hip replacement devices. A large portion of these implants are metal-on-metal devices, like the DePuy ASR hip implant. The DePuy ASR device is a popular option for many patients seeking a hip implant.
