asbestos mesotheliomaA husband and wife have filed a mesothelioma lawsuit against a number of defendants including CBS Corporation, Crane Company, Elliot Turbomachinery Co., Foster Wheeler LLC and General Electric Company that has recently been removed from state court to Connecticut federal court.

According to the mesothelioma lawsuit, plaintiff Douglas L. was exposed to asbestos during his work while employed by Chemtron Corp. from 1959 to 1961 and at Bath Iron Works from 1961 to 1979. He later developed mesothelioma and other asbestos-related pathologies, according to the claim.

Mesothelioma is a rare cancer of the mesothelium, the lining of the lungs, abdomen or heart, and most cases of mesothelioma affect the lining of the lungs in particular. Mesothelioma is almost exclusively caused by exposure to asbestos.

When an individual inhales or ingests asbestos, the fibers can cause inflammation and can lead to the development of cancerous cells in the body.

Mesothelioma has a poor prognosis, as it is typically diagnosed at a later stage. Many individuals are not diagnosed until 50 or 60 years after their initial exposure to asbestos.

Some types of surgery and chemotherapy may assist in helping to treat some of the related pathologies, but these interventions are typically not as successful as they are for other types of cancers.

The mesothelioma lawsuit states, “Upon information and belief, the defendants, through their agents and employees, mined, processed, manufactured, designed, tested and/or packaged various asbestos-containing products, and supplied, distributed, delivered, marketed and/or sold said asbestos-containing products to the employer(s) of the plaintiff to others working at the various job sites where the plaintiff was employed…”

The asbestos-containing products were unreasonably defective in a number of ways, the mesothelioma lawsuit states. It goes on to say that the asbestos-containing products were unavoidably unsafe and that proper warnings were not made to Douglas.

The complaint also states that implied or expressed warranties were breached because the products were not safe for their intended purposes.

The illnesses that the asbestos-containing products now suffers from has caused Douglas “to suffer great pain, suffering, mental anxiety, distress of mind, humiliation, emotional trauma and mental anguish,” the complaint reads.

Illnesses have also caused shortening of life span for Douglas and reduced capacity to enjoy life and carry out his activities.

Additionally, Douglas has incurred expenses for medical, hospital, surgical treatments, drugs, medicines, x-rays and more and his earning capacity has been impaired, the mesothelioma lawsuit states.

Plaintiff Donna L., Douglas’s wife, has also brought forth allegations in the claim that she has suffered damages by losing spousal companionship with her husband and has also suffered “the loss and impairment of the plaintiff’s certain, protection, care and assistance, society, companionship, affection, love, comfort, support, guidance, and kindly offices and advice, and other benefits of the marital relationship.”

Donna and Douglas are seeking judgment against the defendants and are seeking damages, attorneys’ fees and costs and any additional relief deemed right and just by the court.

The Mesothelioma Lawsuit is Case No. 3:17-cv-00799 in the U.S. District Court for the District of Connecticut.
