From 1951 until 1988, Charles P., the deceased man, worked as a machinist and design liaison for General Dynamics Corporation and Electric Boat Corporation at Electric Boat Shipyard.

General Electric and the other named defendants, including CBS Corporation and Foster Wheeler, have assumed the assets and liabilities of their predecessors and, according to this asbestos lung cancer lawsuit, are now responsible.

Asbestos Lung Cancer Lawsuit Filed by Family of Deceased Man

For nearly 30 years of his employment, Charles’ duties included requiring him to work in areas where he and others regularly handled and worked with asbestos products or products containing asbestos.

He was regularly exposed to asbestos fibers and materials manufactured by the defendants.

Charles, according to his family’s asbestos lung cancer lawsuit, was diagnosed with lung cancer, asbestos-related lung disease and loss of lung function. He suffered from the effects, symptoms and conditions of asbestos-related lung disease.

He endured significant amounts of pain and mental anguish. His capacity to earn money was impaired, he was restricted daily activities and he was required to spend large amounts of money on his treatment.

This asbestos lung cancer lawsuit claims that he suffered grief, fear and anguish over his condition, the pain caused by his symptoms, the worsening of his symptoms, his premature death and the effect his premature death would have on his family.

On June 30, 2014, Charles died from asbestos-related injuries, the asbestos lung cancer lawsuit claims.

His family seeks compensation for the fact that he and his family were denied life’s enjoyments, earnings and incurred expenses for medical care and funeral costs.

Their asbestos lung cancer lawsuit also raises a claim for loss of consortium on behalf of Charles’ wife, stating, “The illness and injuries suffered prior to his death resulting from exposure to asbestos products deprived his spouse, [Roselle], of the comfort, support, service and consortium to which she is entitled.”

The defendants’ actions should be considered “wanton and willful,” according to this asbestos lung cancer lawsuit, and they demonstrated a reckless disregard for the consequences they knew or should have known would result.

The lawsuit also claims that the defendants should have notified Charles once they learned of the asbestos dangers after they were aware of others’ illnesses, and that they conspired to keep this knowledge from the general public.

Charles’ family believes that the defendants should have taken proper safety precautions, adopted and enforced a safety plan and warned workers of the dangers of coming into contact with asbestos or breathing asbestos fibers.

Asbestos is mineral that was used in construction during the 20th century and became popular because of its flame retardant qualities.

However, breathing asbestos fibers is extremely harmful and can be life-threatening.

When asbestos fibers are breathed in, they can become trapped in the lungs. When asbestos fibers become “friable,” that is easily crumbled and thus released into the air, it is at its most hazardous.
