Bud Light Platinum Seltzer Class Action Lawsuit Overview: 

  • Who: Anheuser-Busch, LLC has been hit with a class action lawsuit for alleged false advertising of its Bud Light Platinum hard seltzer products. 
  • Why: Consumers allege that the company violates consumer fraud laws and negligently misrepresented its ‘Platinum Hard Seltzer – Made With Agave’ drinks, saying they do not contain any pure agave spirits.
  • Where: The lawsuit, filed in Illinois, is for anyone who bought the seltzer in Illinois, Arkansas, and Iowa.

Bud Light ‘Platinum Hard Seltzer – Made With Agave’ drinks do not contain any agave spirits as consumers are led to believe, and are instead made with a cheaper, lower quality agave syrup, a new class action lawsuit alleges.

The class action was filed in Illinois Tuesday by lead plaintiff Stella Khaimova who alleges that Anheuser-Busch, LLC, which manufactures Bud Light-branded products, violates consumer fraud laws and negligently misrepresents the hard seltzer products.

Khaimova says that the company’s statements on the front of the hard seltzer cans — “Platinum Seltzer,” “Made With Agave,” and “8% ALC/VOL” — all indicate that the drinks are made from the popular agave spirit, found in tequila and mezcal.

“The representations are misleading because they give consumers the impression the Product contains a more valued type of agave ingredients than it does,” she alleges.

Consumers Expect More From Bud Light Platinum Seltzer, Says Consumer

Khaimova says that whether a product is made with agave spirits is basic front label information consumers rely on when making quick decisions when buying alcoholic beverages.  

She says she relied on Anheuser-Busch’s statements when buying the 6-pack of Bud Light Platinum seltzer, only to find the drinks lack any agave spirits, and instead use “Agave Syrup,” as shown in the fine print ingredient list on the back of the Product.

Agave syrup, also known as maguey syrup or agave nectar, is a sweetener derived from the agave plant. Blue-agave syrup contains 56 percent fructose as a sugar, and because of that it has been added to a number of ready-to-drink (RTD) products, the claim reads. 

However, agave syrup is of much lower quality than agave spirits.

Agave is a perennial succulent often mistaken for cactus, and is traditionally the main ingredient in tequila. As of 2021, agave-based spirits are the third largest spirits category in the US, behind vodka and whisky, the claim explains. 

Anheuser-Busch jumped on the popularity of agave by marketing its drink to emphasize the agave plant, including on the front of the cans, the lawsuit alleges, without using any of the genuine form of the product.

Had Plaintiff and proposed class members known the truth, they would not have bought the Product or would have paid less for it,” the claim states, adding that at $9.99 for a six-pack of 12 oz cans, the Bud Light Platinum seltzers demand a higher price than they would otherwise, absent the misleading representations and omissions.

Khaimova wants to represent anyone who bought the hard seltzer in Illinois, Arkansas, and Iowa. She is suing for violations of the Illinois Consumer Fraud and Deceptive Business Practices Act, state consumer fraud acts, breaches of express warranty, negligent misrepresentation, and unjust enrichment. She seeks certification of the Class, damages, injunctive relief, legal fees and costs, interest, and a jury trial.

Khaimova’s class action lawsuit isn’t the only one Anheuser-Busch is facing over its hard seltzer products. 

In September, another consumer lodged a class action lawsuit alleging the company falsely advertised its Travis Scott-endorsed “Agave Spiked Seltzer,” sold under the Cacti brand, saying the drinks do not contain the pure agave consumers are led to believe they contain.

Competitor Boston Beer Company has been accused of using misleading imagery and labeling to falsely advertise Truly Hard Seltzer flavors — duping consumers into thinking they contain fruit in another class action lawsuit.
