Amazon Settles Internet Explorer Privacy Class Action Lawsuit

Amazon.com has agreed to settle a 2011 class action lawsuit accusing the company of circumventing the privacy settings of Internet Explorer users, according to court papers filed Thursday.
The Amazon privacy settlement will resolve a class action lawsuit, titled Del Vecchio v. Amazon, that alleges the online retailer tricked Microsoft’s Internet Explorer into thinking the e-commerce site was “more privacy-protective than it actually is,” and used Flash cookies to collect users’ personal information even if they had set their browser to block cookies. The personal information collected from users was then allegedly shared with other companies without their permission to serve them targeted ads, according to the class action lawsuit.
The Amazon privacy class action lawsuit was dismissed last year on the ground that the plaintiffs didn’t allege they were harmed by Amazon. The plaintiffs revised their complaint in January. Shortly after, Amazon asked a judge to dismiss the amended class action lawsuit, but it was settled before a ruling was made.
The Amazon.com flash cookie class action lawsuit was brought on behalf of anyone who has used Internet Explorer versions 6, 7 or 8 – with high privacy settings – to visit Amazon.com to purchase products there. It is seeking injunctive relief and monetary damages, which could potentially be shared by millions of consumers.
