Amazonโs near-monopoly over the online retail market has forced more than 100 million customers to pay more for products than they should have, a new class action lawsuit alleges.ย
Amazon customers filed the class action lawsuit Wednesday in a Washington federal court, alleging violations of the Sherman Act, including monopolization, Law360 reported.
Plaintiff Megan Smith says Amazon.com charges merchants โreferral fees,โ which they have to pay in order to sell their products on one of the largest marketplaces in the world.ย
She says these charges are ultimately passed on to consumers, which would not happen in a healthy, competitive market.ย
The tech giantโs โpolicy of overcharging consumers is woven into the fabric of Amazonโs existence,โ Smith alleges.ย
As well as the referral fees, Amazon does not allow sellers to market their products at cheaper rates anywhere else online, creating another type of price fixing. Plus, Amazon goes on to undercut those same merchants on its site by selling the same products at a cheaper rate.ย
โBecause the merchantsโ goods are overpriced due to the existence of the โreferral fees,โ Amazon is able to undercut the merchantsโ prices with its own Amazon-label branded goods โ vanquishing competition and eliminating consumer freedom to purchase the goods they seek in a normal functioning market free of anticompetitive conduct,โ Smith says.
Sheโs looking to represent a nationwide class of more than 100 million consumers who bought items through Amazon from May 2017 onwards. Sheโs seeking damages, costs, fees, and an order preventing Amazonโs alleged violations of law.ย
Meanwhile, Amazon is facing another class action lawsuit over its Alexa device. Plaintiffs in the June class action complaint say the device is eavesdropping on private conversations, recording and storing them on an Amazon server for the multinational company to use at its will.ย
Plaintiffs say they are taking action against Amazonโs alleged practice of using smart- speaker technology to surreptitiously save permanent recordings of millions of Americansโ voices, all without their knowledge or consent.ย

Yes Amazon has been getting away with this practice for many years. And the biggest problem is once you purchase a product from a third-party seller they sell junk. When you ask for a refund to return the product thatโs when the the process becomes the biggest issue. Itโs up to the third-party seller to give you a refund and most of the time the third party will delay and delay and delay so it takes a long time to even get your refund back. Amazonโs been doing this also for many years.
Regarding the Alexa Iโve been saying that for a while that theyโve been eavesdropping on conversations I noticed different things with the Alexa device that is very concerning and questionable. But how can you prove that Alexa is storing our conversations. Like I said Iโve seen Alexa do some very odd things while youโre sitting there just really doing nothing or having a conversation or something device does odd things that changes colors and you can it starts to do something strange and thereโs no explanation about it.
On another note regarding everybody saying add me what happens is it that you need to fill out the claim form Wednesday lawsuit goes through they canโt just automatically add you.
