Amazon Resistance Band Class Action Lawsuit Overview:
- Who: A woman who bought a resistance training band on Amazon that broke, injuring her, is suing the retailer and certain workout gear companies.
- Why: The woman claims the companies sold unsafe workout gear, rendering her now “unable to perform the duties of a wife.”
- Where: The lawsuit was filed in a New Jersey federal court.
Amazon and certain workout gear manufacturers are being sued by a consumer who says she was injured by a broken workout band, rendering her unable to perform “all the duties of a wife.”
Plaintiff Rona Koenig filed the product liability lawsuit against Amazon.com Inc. and the manufacturers in a New Jersey federal court April 11. Her husband, Ronald Koenig, is also a plaintiff in the lawsuit.
According to the lawsuit, Rona Koenig suffered permanent injuries when one of the resistance bands she bought snapped.
The injuries were not explicitly stated in the suit, but Koenig claims in her complaint that they were “severe,” costing her the loss of enjoyment of life.
“Said plaintiff has been unable to perform the duties of a wife and as a result thereof, the plaintiff, Ronald Koenig, has been deprived of society, companionship and consortium of [Rona Koening],” the lawsuit states.
Amazon Workout Products Were Defective, Class Action Alleges
Rona Koening bought the bands on Amazon in August 2021 and subsequently got hurt in October, according to the complaint. She says she suffered pain and suffering and had to pay medical expenses.
She alleges the retailer is responsible because it helped sell the allegedly unsafe bands. She also claims the product was defectively made or poorly inspected before being shipped out.
Fitness equipment companies Veick Sports, Junlong Sports Co., Rolaz and Changzhou Hengdasuliao Zhipinchang were named as suppliers, manufacturers and distributors of the band.
The companies breached warranty by selling a product not suitable to withstand the use it was intended for, the Koenigs allege. They say the amount in controversy is more than $75,000.
Meanwhile, spices sold by Amazon.com under its Happy Belly brand contain toxic heavy metals, including arsenic, cadmium and lead, a new class action lawsuit alleges.
Plaintiffs in that case claim Amazon neither lists the toxic heavy metals in the spices’ ingredients list nor warns consumers that they may potentially be present.
