Plaintiff Delight S. files the asbestos mesothelioma lawsuit on behalf of her deceased husband, David S. She files the lawsuit in California federal court. The lawsuit was filed on June 21, 2018.
According to the asbestos mesothelioma lawsuit, David became exposed to asbestos, debris and asbestos-containing dust leading to his development of mesothelioma.
Delight says David became diagnosed with mesothelioma on or about September 2017 and died on Nov 18, 2017. Delight says that she has “suffered from the loss of love, comfort, society, attention of decedent, and the loss of earnings, earning capacity, services and support of decedent…”
The asbestos mesothelioma lawsuit was filed on multiple counts including negligence, breach of express and implied warranties, strict liability in tort, and premises owner/contractor liability.
Overview: Asbestos Mesothelioma Lawsuit
According to the Mayo Clinic, mesothelioma is a “type of cancer that occurs in the thin layer of tissue that covers the majority of your internal organs (mesothelium).” The most common kind of mesothelioma that develops is pleural mesothelioma, a cancer that affects the tissue surrounding the lungs.

Particularly, building and construction industries have extensively used asbestos, especially within plastics and cement for use in things such as sound absorption, roofing, insulation, and fireproofing. The automotive industry has also extensively used asbestos, such as in clutch pads and brake shoes. Asbestos can also be found in adhesives, paints, coatings, and floor tiles.
However, new uses of asbestos were banned by the U.S. Environmental Protection Agency (EPA) in 1989. The fiber, while heavily used and versatile, is also categorized as a human carcinogen by the U.S. Department of Health and Human Services (HHS), the International Agency for Research on Cancer (IARC), and the EPA.
