Abbott glucose sensor class action lawsuit overview:

  • Who: Plaintiff Bijoy Shroff filed a class action lawsuit against Abbott Diabetes Care Inc. and Abbott Laboratories.
  • Why: Shroff claims Abbott sold its FreeStyle Libre 3 and FreeStyle Libre 3 Plus glucose sensors with a defect that caused them to report falsely low glucose readings.
  • Where: The class action lawsuit was filed in California federal court.

Abbott knowingly sold FreeStyle Libre 3 and FreeStyle Libre 3 Plus glucose sensors with a defect that caused them to report falsely low glucose readings, a new class action lawsuit alleges.

Plaintiff Bijoy Shroff claims Abbott sold the sensors without disclosing the defect and only initiated a recall after hundreds of serious injuries and seven deaths were reported.

Shroff further argues Abbott sold the sensors as being effective for monitoring glucose levels — including by marketing them as having “unsurpassed accuracy” to the point they eliminated the need for fingersticks — while failing to disclose that they were defective. 

“Abbott’s misconduct caused substantial harm and injuries to Plaintiff and Class members across the United States,” the Abbott class action claims.

Shroff wants to represent a nationwide class and Florida subclass of consumers who purchased the FreeStyle Libre 3 or the FreeStyle Libre 3 Plus glucose sensors.

Abbott knew about defect through internal testing, surveillance, class action alleges

Shroff claims the U.S. Food and Drug Administration determined the sensors were defective due to a manufacturing flaw in a production line.

Abbott, meanwhile, failed to publicly disclose the glucose sensor defect or initiate a broad corrective action until November 2025, long after the defect manifested in the market, and despite knowing about the defect through its own internal testing and surveillance, the Abbott class action alleges. 

“Abbott’s delayed disclosure deprived consumers of important safety information necessary for their evaluation of whether to continue purchasing and using the Sensors,” the Abbott class action says.

Shroff claims Abbott is guilty of fraudulent omission or concealment and unjust enrichment, and violated the California Consumers Legal Remedies Act and the Florida Unfair and Deceptive Trade Practices Act.

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of actual or nominal damages for himself and all class members. 

Abbott issued a recall notice on Dec. 3, 2025, for more than 350,000 FreeStyle Libre glucose monitoring systems over concerns about incorrect low glucose readings.
