FACTA was passed by Congress in 2003. According to the act no person who accepts credit cards or debit cards for business purposes can print more than the last five digits of the consumer’s credit or debit card number.

Businesses taking credit card transactions are also prohibited from printing any portion of the card’s expiration date on the transaction receipt. This means a receipt cannot show the either expiration month or the expiration year.

FACTA applies to all electronically printed receipts, regardless of those printed by cash registers, kiosks, or at restaurants. When businesses violate FACTA, consumers have a right to file a credit card receipt lawsuit against the business.

FACTA lawsuits will help hold companies accountable for their actions and hopefully help minimize cases of credit card fraud and identity theft.

Credit Card Fraud & Identity Theft

Every day Americans are effected by credit card theft and fraud. For many victims their credit card numbers are stolen while the victim’s card is still in his or her physical possession.

Victims of credit card theft and fraud are then faced with the immense inconvenience of replacing and updating their credit card numbers and accounts among other problems.

Its not uncommon for victims to invariably forget to update a direct billing account and be hit with late fees. In some cases victims need to check credit scoring sites to ensure that any false charges have not caused damage to their credit scores.

Although most credit card companies are fast to react and resolve credit card fraud issues in favor of their customers, credit card theft is still a frustrating and inconvenient experience for the victims involved. Credit card fraud is currently one of the nations top concerns.

Credit card fraud and theft can be the result of various factors. In some cases the identity theft can be the result of the victim’s own lack of diligence. Individual consumers can take several actions towards keeping their credit card numbers and identities secure.

The Department of Justice suggests that when making purchases at stores, consumers should check to makes sure no one is looking over their shoulder while completing a transaction. The federal agency also suggests that cardholders limit what they reveal in public while speaking on their cell phones.

Sources suggest consumers avoid holding such conversations in public or moving to a quiet place. Consumers should also think about investing in a paper shredder, that way consumers can destroy all check, credit card, and bank statements prior to throwing them away.

Unfortunately even with the upmost care consumers may still become victims of credit card theft. Many thieves use special technology in order to steal credit cards.

Sometimes they install skimmers in ATMs or gas station pumps. This gives them access to the card numbers which allows them to later make a replica of the card or make online purchases.
