woman suffers dangerous Essure side effectsThe most recent woman to allege that she has suffered dangerous Essure side effects has filed a lawsuit. Plaintiff Christine P. is the latest woman to claim that she was never warned about Essure side effects before receiving the permanent form of birth control.

The Essure side effects lawsuit says that the Bayer Corporation is responsible for failure to warn the medical community and potential patients about the possibility of significant and severe problems after receiving the Essure birth control.

Christine filed a complaint for damages from dangerous Essure side effects in Pennsylvania state court on Nov. 30, 2018, as a result of the permanent and severe injuries she says she received due to using the birth control device.

Essure Lawsuits

She and many other women have come forward to lodge their complaints about dangerous Essure side effects after they have experienced severe symptoms that compromised their overall health.

Many of the women who lodged an Essure lawsuit or filed adverse event reports with the FDA say that the manufacturer has done little to warn users of the device about the possibility of side effects like migration, bleeding, pain and ectopic pregnancies.

Christine’s lawsuit alleges that the manufacturers should have been aware of the dangers and failed to disclose these appropriately after putting their medical device on the market. It also points out that the defendants in that lawsuit had previously been cited by the Department of Health and the FDA for a number of different problems related to Essure, including but not limited to:

  • Manufacturing Essure in an unlicensed facility
  • Failing to report and making an effort to conceal eight perforations that occurred with patients who received Essure
  • Failing to use pre-sterile and post-sterile cages
  • Not reporting complaints in which their product migrated throughout the patient’s body
  • Failing to have a complete design failure analysis
  • Failing to track the non-conforming product

The Essure side effects lawsuit furthermore points out that the FDA discovered in 2013 an internal spreadsheet that contained more than 16,000 complaints that were never reported directly to the agency. The FDA called for the strictest warning label possible to be added to the device.

Christine’s Complaint

In her Essure side effects lawsuit, Christine says that she underwent the Essure procedure in Michigan in February 2016.

Shortly after undergoing implantation, a simple outpatient procedure, Christine alleges that she began to suffer a number of side effects, including cramping, unusual bleeding, pain, and an irregular menstruation cycle. She states that she ultimately had to get a total laparoscopic hysterectomy in January 2018.

She says that she relied on the information shared by the manufacturers of Essure to make the decision about receiving the device to begin with. Christine alleges that the Essure marketing materials developed and promoted by the company said that it was a safe and effective form of birth control.

Women who received Essure in the past and have experienced problems with migration or other problems should report these concerns to their doctor immediately. Some victims have taken to filing legal action in an effort to hold Bayer Healthcare, the manufacturer, accountable.

The Essure Side Effects Lawsuit is Case No. 2:18-cv-05353-MMB in the U.S. District Court for the Eastern District of Pennsylvania.

In general, Essure lawsuits are filed individually by each plaintiff and are not class actions.
