A group of Excelsior College students who claim the private school places endless barriers to prevent nursing program enrollees from actually graduating, have asked a New York federal court to certify their putative class action lawsuit.

Plaintiff Jessica Willis along with numerous other Excelsior student plaintiffs seek to represent all individuals who enrolled in the nursing program since Aug. 13, 2012 and experienced delays in taking the Clinical Performance in Nursing Examination test and/or failed the CPNE within the same time period.ย 

According to the motion for certification, the lawsuit meets all the requirements for Class certification including โ€œnumerosity, commonality, typicality and adequacy of representation.โ€

The Excelsior class action lawsuit states that the college primarily targets students who are unable to attend a traditional nursing school by promising them that they can finish the program in as little as 18 months.

However, the plaintiffs say that repeated and intentional road blocks delay students from graduating.

The Excelsior College class action lawsuit claims that out of 10,000 students enrolled in the nursing program, less than 10 percent of those end up graduating each year.

Part of the reason why there is such a low graduation rate is because Excelsior hides from students the fact that less than half of them will actually pass the final test, the plaintiffs state.

โ€œFor example, whereas the actual CPNE pass rate for 2017 was only 39.5%โ€ฆExcelsior misled and continues to mislead consumers into believing that the pass rate is and has been 62.2%,โ€ the Excelsior nursing program class action lawsuit alleges.

According to the Excelsior class action lawsuit, the deception doesnโ€™t end there. In addition to the low success rate on the final exam, Excelsior students experience delays of more than one year to even take the test, despite the college representing that students only have to wait three to five months.

Willis claims she was one of the students tricked by the omissions and intentional untrue statements made by the college regarding test pass rates and accreditation.

The plaintiff, who has been an LPN since 2010, says she enrolled in Excelsiorโ€™s nursing program in 2015 with the understanding that it would be completed in 18 months.

The Excelsior nursing program class action states that the school hid the fact that the CPNE test had a pass rate of less than 50 percent.

Willis alleges that she received a job offer that was โ€œcontingent upon her having an active RN license by July 2018.โ€ In April 2018, the plaintiff was one of seven Excelsior students who took the CPNE and all of them reportedly failed to pass.

The Excelsior college class action claims that the school recognized that the test failure was wrong by stating โ€œthe exam administration was [not] in accordance with established protocols.โ€

However, the college allegedly did not grant Willis a pass which in turn resulted in her inability to take the offered job position.

The Excelsior college class action states that Willis is among many who experienced โ€œinsistent, persistent and unendingโ€ fraud on behalf of the college.

The Excelsior College students are represented by John Hermina of Hermina Law Group and Gregory Allen of the Law Office of Gregory Allen.

    I am waiting for the current or future administration to look into their practices just like they did for Corinthian Colleges. Too many people have been misled, and are on the losing end of businesses like these.

    I have also become one of those who have not passed the CPNE. I am in the military and have been serving for 14 years as a Corpsman (medical) for Navy. I started to program in 2019 and finished everything. When it came to the CPNE I was already stationed overseas, I paid to fly from Italy to Texas to take the CPNE and was failed on spot for a minor mistake that, in my medical experience, was completely fine. After being failed on spot I was stuck in my hotel room for 2 extra days becuase I could not afford to change my ticket. The proctors were all aware of my situation and showed nothing. I was then told I had to retake and so again had to sign back up within a certain amount of time and save up money to fly once again from Italy, but this time to NY, and yet again was taking my CPNE and one minor mistake, that yet again would be something that I would have been backed up by by another nurse in the real world, but yet was failed again on spot and kicked out and again stuck in my room for another 2 days until I could fly back to Italy. Now I have to start all over with the โ€œnewโ€ curriculum that they have come out with and now have to again order supplies from the school and now they want a no fee class to be taken and then fly back to the states for 1 weekend to do half of the CPNE and then take another class and then fly back yet again to finish the CPNE. They only want money and they have taken all of my
    GI Bill that I had worked hard for the past 14 years of my military career. They will not allow me to put a pause on my degree without paperwork showing that I can not finish until stateside. They want me to get loans for the classes and pay for my flights. I work at a military hospital and they will not even allow me to complete anything here with certified RNs or Doctors. I remember the second time I went to take the exam I was one of 5 that also failed the first time. I would love to at least have my associates that I have worked so hard for and or at least get my money back that I have spent on this never ending program.

    I too had been a lpn for many years; went to Excelsior. It only took me around 1 half to 2 years because I was not working. I finish all my classes and get to the last 2 exams that you take through excelsior and my Husband had a 90% heart blockage and I notified them asap and asked if I can reschedule and they told me no and I was done. Iโ€™m out of the program. I was like WTF. I kept calling them and trying to explain this was an emergency. I asked my husband Cardiologist for a note . It was ridiculous. They didnโ€™t care. I was so hurt for all the hard work I had did. I agree with all of you Excelsior need to compensate each and every one of us.

    Excelsior is a scam. They design it so you fail multiple times and they can get more and more money from you. I have no RN degree and still paying off loans til this day.

      OMG!!! Iโ€™m in the same Boat with you, 44,000 and no RN Degree. Something has to be done about this program.

    I was enrolled with Excelsior College and completed all of my program courses to become an RN with an Associates. I had 7 years to complete the program. Unfortunately, they lost their accreditation and Wisconsin was no longer accepting nurses from their program. The deadline to graduate was March 7, 2021. Due to Covid, my CPNE/Capstone was done via Zoom and I failed. I had to make that deadline or I would not be able to sit for my boards. I failed 3 times, with them pushing me to hurry up before the deadline. I did even get my clinical.

    All my classes are complete. I now have to find another program so I can finish. Excelsior partnered with the University of Arkansas to help those, from Excelsior, in my situation. I havenโ€™t applied there yet because they donโ€™t seem too eager to help and how can you learn IV therapy online? Any other school, I will be required to re-take all of the core nursing classes., that Iโ€™ve already paid for and passes.

    I donโ€™t even know where to begin 18 mos turned into almost 7 years and no way out . I finished my classes in oct 2019 and here we are in 2021 just took my Cpne for the third time and failed . To add insult to injury I was told that I would not be able to perform in a hospital environment . I was not aware that getting a job at a hospital was contingent on doing a perfect care plan. Also we were given a tool and were not taught how to use it docucare no instructions on how to navigate it so you are set up to fail . There not one video on teaching you couldnโ€™t even find one on the internet , provably because the themselves donโ€™t know how to use it. This program has taken everything from me . I was always taught that clinical is a learning experience . I have been an Lpn for 20 plus years oriented many brand new RNs who are learning as they work they donโ€™t know how to do every thing perfect and many things they have never done but we donโ€™t judge them we teach them.

      Jillian I as well took the CPNE it took the CPNE in March for the 3rd time and for the 3rd time and failed as well not because I didnโ€™t not because I didnโ€™t do well on the Visa because I got a 100% because I got a 100% and not because I didnโ€™t know the charging system being I didnโ€™t know the charting system because I as well got a 100% however they croissant however they accused me of cheating because there was 5 clients there was 5 clients on the maternity pediatric is it portion of the test practice V practice visas that apparently they sent me an email on December 3rd at me an email on December 30th telling me I couldnโ€™t access however I was unaware access however I was unaware that the email even existed I as well in searching for I as well in searching for any resolution to this issue as now I am for this issue as now I am forced to start over again and Iโ€™m starting with a different college and Iโ€™m starting with a different college as of August

    I was planning to enroll with this college so I should I quit? I canโ€™t believe the many negative comments here and none stating the goodness of this college????

      They lost their RN program accreditation on May 11, 2021. I managed to graduate on the 10th but they wonโ€™t let me take the NCLEX until I go through an ATI review. They paid for it but the program at ATI makes about as much sense as the schoolโ€™s โ€“ ridiculous! I wish you all the best in your continuing education, but as a former student who is being held hostage (they wonโ€™t greenlight me for the NCLEX without passing the ATI program) I hope you didnโ€™t enroll here. They are using anyone who managed to finish to try and regain their accreditation by insisting that we take an additional program of classes through ATI โ€“ at least thatโ€™s how I see it. They want statistics for NCLEX passing to reapply for accreditation, so we must still do their bidding even after we have our degrees. Please go to another school โ€“ you will be great at RN and you can do it!

    How do we get some kind of compensation? I spent years working on this program between 2006 and 2016. I passed all tests but when it came to the CPNE; their was never any available spots for 9+ months and I could not pay $2295 for a test I would have to take almost a year for???? This was not a practical program.

    I enrolled with several woman all LPN and their presentation made it seem all would b ok but after months of frustration, I dropped it and so did everyone else. I want my money back. Iโ€™ll join the law suit also..
