UPDATE: November 2018, the commercial truck parking heater indirect purchaser class action settlement is now open. Click here to file a claim.

Webasto and other defendants have agreed to pay $15 million to settle claims that the companies conspired to fix the price of an aftermarket commercial vehicle accessory, the parking heater.

Parking heaters are sold to commercial truck owners as a way to create heat inside the vehicle without needing to keep the engine running.

If you purchased an aftermarket parking heater for your commercial vehicle from Webasto or Espar between Oct. 1, 2007 and Dec. 31, 2012, you could get cash from this settlement.

Plaintiffs in the parking heater class action lawsuit reached the settlement with defendants Webasto Products North America, Inc., Webasto Thermo & Comfort North America, Inc. Webasto Thermo & Comfort SE, Eberspaecher Climate Control Systems GmbH & Co. KG, Espar, Inc., and Espar Products Inc.

The Webasto defendants have agreed to pay up to $7 million and the Espar defendants have agreed to pay up to $8 million, for a total settlement of $15 million.

The parking heater class action lawsuit was filed in April 2016, alleging that Webasto and Espar illegally conspired to fix the price of parking heaters at a higher price than was fair market value. Plaintiffs in the class action claimed that these actions were in violation of antitrust laws.

Settlement payments will be calculated based on purchase data, and each Class Member will have a unique ID number attached to their purchase data. ID numbers were included in the notices mailed to Class Members.

Eligible parking heater consumers are not required to fill out a Claim Form in order to receive a payment, but consumers who were not sent a notice have until Feb. 1, 2019 to file a Claim Form.

Commercial truck owners have until Dec. 1, 2018 to object to or exclude themselves from the class action lawsuit settlement. The final approval hearing is scheduled for Jan. 9, 2018.

Class counsel will be paid from the settlement fund, although they cannot request more than one third of the total settlement fund as payment.
