TCA viewers are reporting that they have received checks worth as much as $116.85 in the Hustler Hollywood credit card receipt class action settlement.

The Hustler Hollywood class action lawsuit alleged that the owner of the chain of adult stores, HH-Entertainment Inc., violated federal law when customers were given receipts with more than the last five digits of their credit or debit card account number. The lead plaintiff, Wade Glen Whitworth JR., alleged that by including this information, Hustler Hollywood customers’ privacy was put at risk.

 

 

In addition, the Hustler Hollywood class action lawsuit argued that the company violated the Fair and Accurate Credit Transactions Act (FACTA).

Enacted in 2003, FACTA restricts the information that retailers can put on consumer receipts regarding credit or debit card transactions. FACTA was enacted by Congress to help protect consumers from identity theft and fraud. Under FACTA, receipts must only contain the last five digits of a credit or debit card number. The numbers can be replaced by symbols, such as “*” or “#.”

The Hustler Hollywood class action lawsuit alleged that the company violated FACTA by including more than the last five digits.

Companies can also violate FACTA by including the expiration dates of credit or debit cards on receipts. Companies found to violate FACTA can be subject to steep fines.

Under the terms of the Hustler Hollywood credit card receipt settlement, HH-Entertainment agreed to pay $750,000 to end claims. Class Members included those who, between April 18, 2015 and Feb. 26, 2018, were provided a receipt at a Hustler Hollywood location that contained more than the last five digits of their credit or debit card number.

HH-Entertainment admitted no liability in the Hustler Hollywood credit card receipt class action lawsuit under the terms of the settlement.

The deadline to file a claim was July 12, 2018. In a final approval hearing, the Hustler Hollywood class action settlement was approved.
