Older asian man being fed by nurse in bedA New York patient has filed a nursing home injury lawsuit, saying that her caretaker’s negligence during a day trip resulted in her injury.

Plaintiff Blanche E. has filed a nursing home injury lawsuit against Atria Senior Living, a company that runs the Atria Plainview senior living facility where Blanche says she resides, and against her caretaker, Nancy W.

Blanche claims that Atria employees escorted her and a group of other residents to Fire Island on a day trip. She says that during this time, she was sitting backward on her walker, being pushed forward by Nancy, when she was caused to fall over backwards and hit her head on the ground, causing her injury.

According to Blanche, this injury was caused by Nancy’s negligence in care. Additionally, she says that she had to get medical attention to treat her injuries. She says that she incurred medical bills and financial injury as a result of the treatment she required.

The New York nursing home lawsuit aims to hold both Nancy and Atria liable for Blanche’s injury, and seeks damages to compensate for the physical, emotional, and financial injury she suffered. Blanche claims that the accident occurred solely because of negligence on the part of Nancy and the company, and was in no way a result of Blanche’s negligence.

Around the country, concern is rising over the issue of nursing home neglect.
