A New York patient has filed a nursing home injury lawsuit, saying that her caretaker’s negligence during a day trip resulted in her injury.
Plaintiff Blanche E. has filed a nursing home injury lawsuit against Atria Senior Living, a company that runs the Atria Plainview senior living facility where Blanche says she resides, and against her caretaker, Nancy W.
Blanche claims that Atria employees escorted her and a group of other residents to Fire Island on a day trip. She says that during this time, she was sitting backward on her walker, being pushed forward by Nancy, when she was caused to fall over backwards and hit her head on the ground, causing her injury.
According to Blanche, this injury was caused by Nancy’s negligence in care. Additionally, she says that she had to get medical attention to treat her injuries. She says that she incurred medical bills and financial injury as a result of the treatment she required.
The New York nursing home lawsuit aims to hold both Nancy and Atria liable for Blanche’s injury, and seeks damages to compensate for the physical, emotional, and financial injury she suffered. Blanche claims that the accident occurred solely because of negligence on the part of Nancy and the company, and was in no way a result of Blanche’s negligence.
Around the country, concern is rising over the issue of nursing home neglect. Reportedly, millions of Americans over age 60 are neglected or abused at nursing homes or other facilities on which they rely for care. ABC News reports that 1 in 3 nursing home facilities may perpetuate neglect or abuse.
Nursing home neglect is a difficult problem to fix, because a vast majority of these cases aren’t reported. Additionally, the person in the facility and that is experiencing abuse may not be able to express concern over their care, and in many cases, family members aren’t aware if their loved one is being abused or neglected.
One of the most common signs of nursing home neglect or injury is a patient whose health declines or has signs of injury when they are in the care of a nursing home. Elder neglect can often lead to physical injury or medical issues when the patient is not being adequately cared for.
Nursing home injuries that can indicate abuse or neglect include bruising, fractures, malnutrition, dehydration, frequent urinary tract infections, bed sores, and pressure sores.
If you or a loved one have suffered nursing home neglect or injury, you may qualify for a nursing home injury lawsuit. Filling a nursing home injury lawsuit can help gain you compensation for injury and can help hold negligent facilities accountable for injury they have caused residents. Contacting an experienced lawyer can help you determine if you have a legal claim.
