Man helping woman with walkerA man has filed a lawsuit against a senior living facility that housed his now deceased family member. He claims that she suffered from neglect and is holding the nursing home responsible for her nursing home hip fracture.

Plaintiff John R. has filed this lawsuit on behalf Alice R. Alice died on Feb. 23, 2018. She was housed at Sunrise Senior Living from Aug. 18, 2011, until the day of her death, John claims.

In his nursing home neglect lawsuit, John alleges Alice suffered from behavioral disturbances and memory problems. John says he assumed that the medical professionals and caregivers at Sunrise Senior Living would render appropriate care to Alice and other residents.

John alleges that if Sunrise Senior Living believed they could not offer proper care of Alice, they should not have kept her as a resident. John claims in his lawsuit that “during her stay at Sunrise, [Alice] was known to be a fall risk.” Also, John alleges, Alice needed assistance with daily activities.

Alice had a history of getting out of bed and wandering the facility. John alleges that the staff of Sunrise Senior Living knew about this history. Even so, the staff at Sunrise Senior Living allowed Alice to continue living there, according to the lawsuit.

Even though it was well-known that Alice was a fall risk and often left her bed to wander, the staff did nothing to safeguard her, John alleges. In July 2016, John alleges that Alice fell and suffered a nursing home hip fracture while trying to get out of bed. John says that Alice fractured her right hip because she was not properly supervised by the facility.

John holds Sunrise Senior Living responsible for Alice’s nursing home hip fracture for many reasons. He believes that they failed to comply with a proper care plan for Alice, as well as failing to provide proper care and supervision for her. They did not provide bed alarms, nor did they monitor her to keep her from sustaining a fall.

He believes that because of Sunrise Senior Living’s careless and negligent care of Alice, her nursing home hip fracture occurred. Allegedly she was left injured and unattended for some time after her fall as well.

According to the lawsuit, Alice “suffered injuries of a personal and pecuniary nature, including but not limited to pain and suffering, disability and disfigurement, medical and related expenses.”

Alice is not the only elderly person who has been allegedly abused or neglected by staff of a nursing home. Unfortunately, Alice suffered a nursing home hip fracture and allegedly died from her injuries and substandard care, but some senior citizens fare even worse.

This Nursing Home Hip Fracture Lawsuit is Case No. 1:18-cv-05328 in the United States District Court for the Northern District of Illinois, Eastern Division.

In general, nursing home neglect lawsuits are filed individually by each plaintiff and are not class actions.
