Consumers who received a prerecorded marketing call from Art Van Furniture may be able to benefit from a $5.8 million Art Van Furniture TCPA class action settlement.
The lead plaintiff, Michael Bowman, accused Art Van Furniture of using prerecorded phone messages to contact him and others in violation of the Telephone Consumer Protection Act (TCPA).
According to the plaintiff, he and other consumers received repeated, unwanted messages from the mid-Western furniture company leading to aggravation, interruption, and lost cellphone battery and minutes.
Bowman alleged in the 2017 Art Van Furniture class action lawsuit that the company cast “too wide a net” when it blanketed the mid-West in annoying prerecorded telephone calls.
Further, the plaintiff claimed that Art Van violated the TCPA’s prohibitions on the use of automatic telephone dialing system and use of artificial or prerecorded voices to contact consumers’ cell phones without their prior express written consent.
The TCPA was enacted to stop the incoming tide of harassing prerecorded advertising phone calls in the early 1990s. The Act was expanded to include communication via fax and text message. The TCPA also put in place the national Do-Not-Call registry and threatened steep fines of up to $1,500 per violation.
Under the terms of the Art Van Furniture TCPA class action settlement, Class Members will receive a share of the $5,875,000 that the company has agreed to pay to end the litigation. Art Van Furniture does not admit any wrongdoing under the terms of the settlement, however.
Class Members have until Sept. 26, 2018 to object to or exclude themselves from the Art Van Furniture TCPA class action settlement.
Who’s Eligible
Class Members include “all individuals and entities who were called by or on behalf of Art Van Furniture through the use of pre-recorded voice technology between May 23, 2013 and July 23, 2018.”

I never recieved a check and the website has been taken down. Who do I contact?
I have not received a check and phone number is not available. Where do I call now?
My check was dated 4 22 and i received it 10. 26. I deposited it and it was returned by my bank it was olfer than 90 days and no longer good .who do i talk to about getting a good check issued
I did’nt receive a check yet, are they still being mailed out? I see they started mailing on April 27th., and some people said they received a check for $114.77.
I received the $114.77 check on April 27. I had completely forgotten about the lawsuit, so it’s like found money (but I bet the attorneys received a better payout).

After reading court docs. the payout to valid claims will not be much $125.00 maybe a lit’ more which is not much at all.from what I read in last post pretty much all claims are valid.good luck everyone
