A woman injured in a recent Pennsylvania auto accident has filed a lawsuit against the driver she alleges was in the wrong, leading to the accident and her subsequent injuries.
The plaintiff, Tina J., alleges she was riding in a car as a passenger in Pennsylvania, when another car ran a red light and collided into hers in an intersection. According to her lawsuit, the Pennsylvania auto accident was caused by the other driver, the result of the defendant “negligently, recklessly and/or carelessly, operating his vehicle.”
The Pennsylvania auto accident allegedly left Tina with severe injuries to her neck, back, head, rib, hip, wrist, nose, and spine, the lawsuit alleges, causing serious and permanent damage. On top of these physical injuries, the lawsuit notes that Tina has also suffered from emotional distress as well as past and future financial losses.
The Pennsylvania auto accident lawsuit was filed on Aug. 9, 2018, in the U.S. District Court for the Eastern District of Pennsylvania. The lawsuit was filed on multiple counts of negligence against the driver of the other vehicle involved, Dawn B., and the car’s owner, Iris S.
Those injured by a car accident may feel helpless in the aftermath, and they, like Tina, are often left to deal with medical and financial problems. However, there are options moving forward to gain some kind of compensation. Filing a car accident lawsuit can help to provide compensation for injuries, medical expenses, and lost wages.
Personal Injury Lawsuits
Vehicle accidents can be devastating, but those who have suffered from car accident injuries may find that filing a personal injury lawsuit can help them with compensation. Personal injury claims, like the ones in this Pennsylvania auto accident lawsuit, rest on the concept of negligence—that is, the idea that another party’s negligence or carelessness led directly to your injuries.
Negligence is legally defined as “the failure to do an act which a reasonably careful person would do, or the doing of an act which a reasonably careful person would not do, under the same or similar circumstances to protect oneself or others from bodily injury, death, property damage.”
In this auto accident lawsuit, Tina argues that the other driver showed lack of car when they allegedly ran the red light, directly leading to her injuries, as well as medical bills and other expenses. Tina also alleges she suffered emotional distress as a direct result of the other driver’s negligence.
Filing a Car Accident Lawsuit
A car accident lawsuit is a common form of personal injury litigation. Other personal injury lawsuits include birth injuries, slip and falls, dog bites, medical malpractice, and work injuries, among many others.
If you have a personal injury claim and want to seek compensation, you may be able to file a lawsuit. A personal injury lawsuit can help compensate for medical bills, lost income, physical pain and suffering, loss of enjoyment of life, disability or disfigurement, property damage, emotional distress, and/or wrongful death. Filing a personal injury lawsuit cannot take away the pain and suffering caused by injuries, but it can help to alleviate the financial burden caused by medical expenses and lost wages.
The Pennsylvania Auto Accident Lawsuit is Case No. 2:18-cv-03375-JS, in the U.S. District Court for the Eastern District of Pennsylvania.
