Capital One TCPA Class Action Lawsuit
Consumers who received a non-emergency cell phone call from Capital One Financial Corp. or another company on behalf of the financial corporation that was placed using an automatic telephone dialing system or a prerecorded voice concerning a collection on a credit card debt may soon receive checks in the mail from the Capital One TCPA class action settlement.
This Capital One settlement resolves the TCPA claims filed against the financial corporation alleging Capital One committed TCPA violations by employing automatic telephone dialing systems and/or prerecorded “robocall” voices to contact consumers’ cellphones without the intended recipients’ prior express consent.
Capital One denies the allegations brought forth against them in this TCPA class action lawsuit. However, the financial company has agreed to a $75 million settlement in order to avoid the risk and uncertainty of continued litigation.
According to the Capital One TCPA class action settlement, individuals who: (1) received an automated call from Capital One between Jan. 18, 2008 and June 30, 2014 concerning a credit card account with Capital One, or (2) received an automated call from AllianceOne Receivables Management Inc., Capital Management Systems LP, and/or Leading Edge Recovery Solutions LLC between Feb. 28, 2009 and June 30, 2014, are considered Class Members of this TCPA class action settlement.
If you are a Class Member as described above and submitted a claim for this settlement, you may soon receive a check for $20 to $40 in the mail from the Capital One TCPA class action settlement fund.
The Capital One TCPA Class Action Lawsuit is In re: Capital One Telephone Consumer Protection Act Litigation, Case No. 1:12-cv-10064, in the U.S. District Court for the Northern District of Illinois
Merrill Lynch Call Recording Class Action Lawsuit
Consumers who are Class Members of the Merrill Lynch call recording class action lawsuit may soon be receiving checks in the mail from the settlement fund. Amounts for the call recording class action settlement checks will vary depending on the size of the Class, though some TCPA class members have already reported receiving checks for more than $200 in the mail.
The call recording class action lawsuit from which this settlement stems was filed in Aug. 17, 2012, by plaintiff Abdullah Byanooni, alleging Merrill Lynch, Pierce Fenner & Smith Inc. and Bank of America Corp. violated California state’s Invasion of Privacy Act when the companies allegedly recorded and/or monitored calls between Byanooni and Merrill Lynch without the plaintiff’s express consent. Furthermore, the Merrill Lynch call recording class action lawsuit alleges the company has a habit of doing this to many consumers, and therefore Byanooni aimed to represent himself as well as a Class of Merrill Lynch California consumers who received a phone call from Merrill Lynch that was recorded or monitored from Aug. 17, 2011 through Aug. 4, 2014.
Merrill Lynch denies all liability in this call recording class action lawsuit, but agreed to settle the case in order to avoid the uncertainty and cost of further litigation. According to the Merrill Lynch class action settlement, the company has agreed to pay $750,000 to establish a settlement fund for the consumers affected by their alleged violation of California’s Invasion of Privacy Act.
The Merrill Lynch Call Recording Class Action Lawsuit is Byanooni v. Merrill Lynch, et al., Case No. CGC-12-523355, in the Superior Court of California, County of San Francisco.
