Top Class Actions viewers are starting to receive checks worth $113.39 from a class action settlement involving allegations Zacks Investment Research Inc. and Zacks Investment Management Inc. used an automatic telephone dialing system to contact consumers without their prior express consent, in violation of the Telephone Consumer Protection Act.

The Zacks class action lawsuit alleged that defendant Response North LLC initiated telemarketing calls about a book published by Zacks or relating to educational seminars, and that it made these calls without the express consent of the recipient.

The Telephone Consumer Protection Act prohibits the use of automatic dialing systems to contact consumers who have not provided their prior express consent to receive such communications. TCPA violations may result in penalties of $500 to $1,500 per violation.

The Zacks class action lawsuit also claimed that Response North recorded some telephone calls with California consumers without their consent, in violation of the California Invasion of Privacy Act. Violations of this law may result in damages of $5,000 per violation or three times the amount of damages suffered.

The defendants denied the allegations but agreed to pay $5.48 million to settle the Zacks telemarketing class action lawsuit and avoid the burden and expense of ongoing litigation.

Three Classes were certified as part of the unsolicited phone call settlement. The Zacks Class includes anyone who, between May 6, 2012 and June 30, 2017, received a call on their cell phone that was made on behalf of Zacks using an automatic telephone dialing system.

The Response North TCPA Class includes Class Members who received a telephone call on their cell phone from Response North that was placed as part of the Zacks book campaign and/or the options trading campaign.

The Response North Privacy Class includes California residents who received a call that was subject to recording by Response North, and the call was received by the recipient in California.

The deadline to file a claim for the Zacks TCPA class action settlement passed on Feb. 16, 2018. The Zacks class action settlement received final approval on April 9, 2018.

    I did receive a check…… as almost 2 years later! A check of $154.61 dated 6/27/18 and I received the check in March 2020. Of course I couldn’t deposit it, I called the number on the check 888 202 1727 and they were not helpful at all. All they said was there’s nothing we can do. So they just kept funds entitled to me.
