A $5.48 million settlement has been reached in a class action lawsuit alleging Zacks Investment Research Inc. and Zacks Investment Management Inc. violated the Telephone Consumer Protection Act by contacting consumers using an automatic telephone dialing system and without obtaining the prior express consent of the recipient.

The TCPA class action lawsuit also alleges that defendant Response North LLC initiated telemarketing calls related to a book published by Zacks or relating to an educational seminar regarding options trading without obtaining the consent of the recipient, in violation of the TCPA.

Additionally, the class action lawsuit alleges that Response North recorded certain telephone calls with California consumers without their consent, in violation of the California Invasion of Privacy Act.

If you received a telephone call from Zacks or if you received a call regarding the Zacks “Beat the Market” book (“Zacks Book Campaign”) or an educational seminar regarding options training (“Options Trading Campaign”), you may be entitled to payment from the Zacks TCPA class action settlement.

The defendants deny the allegations but agreed to settle the Zacks TCPA class action lawsuit to avoid the burden and expense of ongoing litigation. The Zacks defendants have agreed to pay $4.65 million to resolve the litigation and the Response North defendants have agreed to pay $830,000.

The TCPA class action settlement was preliminarily approved on Nov. 17, 2017.

Class Members who would like to opt out of or object to the Zacks TCPA class action settlement must do so no later than Feb. 16, 2018.

Who’s Eligible

Zacks Class: Class Members of the Zacks TCPA settlement include anyone who, between May 6, 2012 and June 30, 2017, received a call on their cell phone initiated by or on behalf of Zacks using an automatic telephone dialing system.

Response North TCPA Class: Includes anyone who received a telephone call on a cell phone from Response North that was placed as part of the Zacks Book Campaign and/or the Options Trading Campaign.

Response North Privacy Class: Includes California residents who received a telephone call on a line that was subject to recording by Response North and which was received by the recipient in the State of California.

Potential Award

$12.57 – $41.90 (estimated)

According to settlement documents, if 100 percent of Class Members submit a claim for the Zacks TCPA class action settlement, then they should expect to receive $17.43. Those filing a claim for the Response North TCPA Class are expected to receive $12.57 and Class Members who file a claim for the Response North Privacy Class should receive $41.90.

Proof of Purchase

N/A. It is recommended that members of the Zacks Class submit documentation such as telephone bills or other documents that support your claim.

Class Members of the Response North Classes should provide the telephone number(s) at which they received calls from Response North on or after September 2014.

    Are your checks being issued for settlement fraudulent? Reading various reply’s being left on your site causes concern? I was informed you would email me a reissue form for a check on this settlement of Kerr vs. Zack Investment. To date have not received this form.     Hello. I received a check for $113.39 dates 6/27/18. I deposit the check with my bank but it was returned and I was charged $12. I was instructed to contact the person who gave me the check for more information. Why was the check not honored?
