Boating Accident Lawsuit Contemplated as Family Mourns Loss of New York TeacherA grieving family recently took steps towards filing a boating accident lawsuit following the death of a teacher in a boating accident.

The family of Eric P. recently announced that they were looking into filing a boating accident lawsuit following Eric’s death after his fishing boat collided with a break wall in New York.

“We are investigating the circumstances and the possible pursuit of a wrongful death cause of action against all responsible parties,” said Eric’s family in a statement, according to a report by WKBW Buffalo.

The family says that in May, Eric was fishing on a boat in New York with two other people when they crashed into a break wall. No one on board was wearing a life jacket, but the two other individuals on the boat were rescued without serious injury, the family says.

The collision with the break wall allegedly caused the accident which killed Eric. Break walls are designed to protect boat harbors from large ocean waves. Often built from rocks, they run parallel to the shoreline and provide calm water for boats to dock at.

Eric was a 7th grade science teacher who had been teaching in Lancaster, N.Y. for almost 20 years. In addition to teaching, he was a lacrosse coach and served as president for the Lancaster Central Teachers Association. Eric’s community has felt the loss of their friend and advocate, making many statements praising his life, WKBW reports.

“On behalf of the wife, two young children, and family of Mr. Przykuta, we sincerely appreciate the prayers and support of the community during this extremely difficult time, and in the years to come that they suddenly now face without their husband, daddy, son and brother, who by all accounts, was an outstanding, hardworking and well-respected coach and teacher in Lancaster,” the Lancaster Central Teachers Association statement said.

In the wake of their loss, Eric’s family is considering a boating accident lawsuit. With the help of a qualified attorney, the family is preserving related evidence and gathering facts to evaluate their case.

A boating accident lawsuit is very similar to a car accident lawsuit. Common boating accidents include collisions between boats, collision with another object, capsizing, explosion, problems with towable objects, and other events which can cause injury or property damage. In each boating accident lawsuit, liability or negligence are determined in a court and damages are paid based on those determinations.

Depending on the situation, the cause of a boating accident may be attributed to driver errors such as not paying attention, alcohol use, lack of training, and reckless navigation. Liability may also be attributed to technical machinery failure, which could be claimed as the fault of manufacturers, or environmental factors such as missing signs, which could be claimed as the fault of the government or water-controlling body.

Damages recovered by a boating accident lawsuit could provide compensation for medical expenses, loss of past and future wages, pain and suffering, property damage, and more. If you or a loved one were injured in a boating accident, contact a qualified attorney to see if you qualify for a boating accident lawsuit.
