Train Accident Lawsuit Filed by Injured PartyA train accident lawsuit has been filed in Pennsylvania on behalf of an injured traveler.

Plaintiff Laura V. has initiated the train accident lawsuit against the National Railroad Passenger Corporation, also known as Amtrak, due to injuries she suffered in Pennsylvania, allegedly based on their negligence.

In 2015, according to the paperwork filed in the Pennsylvania train accident lawsuit, the defendant was operating private passenger trains including one known as Amtrak Train 89. While traveling on rail lines located in and through the Commonwealth of Pennsylvania, Amtrak Train 89 was involved in an accident.

At the time of the train accident, two Amtrak employees were operating a backhoe on the same train track that Train 89 was traveling on. On April 3, 2016, according to the train accident lawsuit, Laura alleges the defendant was operating the train at an unsafe and excessive speed during the same time that the backhoe operated by the other Amtrak employees was operating on the same track. This caused the backhoe and the train to collide and led to the train derailing.

Ultimately, the plaintiff says in her train accident lawsuit, that this falls to the negligence of the defendant. The plaintiff says that she suffered debilitating and severe injuries.

Nearly 40 passengers allegedly suffered similar injuries in that train accident. The train accident lawsuit alleges that the defendant is responsible for failing to coordinate the operation of trains with maintenance and repair being conducted, that they failed to provide and execute for appropriate coordination between employees changing shift, failed to reroute trains, failed to perform random drug tests upon employees and failed to supervise employees to ensure compliance with applicable safety rules, among other allegations.

Filing a Train Accident Lawsuit

Some passengers may not realize that they have an opportunity to get compensation for their injuries by filing a train accident lawsuit if the company or engineers have any responsibility for causing the accident to begin with.

After suffering severe injuries, if plaintiffs can show that the train company or employees working for it were the primary cause of the accident, a train accident lawsuit can be filed by either the victims on the train or the surviving family members who lost their loved ones in the crash.

Since trains are such large vehicles and often travel at fast speeds, an accident linked to a train engineer’s behavior can have catastrophic results for passengers on the train. This is why a legal claim for recovery might be filed by those injured.

Plaintiffs who are hurt in a train accident might be eligible to pursue compensation by filing a lawsuit with the help of an experienced attorney. Those injured passengers may have no other option but to initiate a lawsuit directly against the company managing the trains in order to get support for their medical bills and other costs directly tied to the accident.

The Train Accident Lawsuit is Case No. 2:18-CV-02488-GAM filed in the United States District Court for the Eastern District of Pennsylvania.
