Texas State Court Awards Family $90M in Truck Accident SettlementWerner Enterprises Inc., found liable for a trucking accident collision, has been hit with a nearly $90 million verdict in a recent truck accident settlement announced by a Texas state court.

The Houston jury found Werner responsible for a trucking accident that paralyzed a 12-year old, killed a 7-year-old, and left the mother of the family, Jennifer B. and left another son, Nathan B. with serious and extensive brain injuries, according to Law360.

According to the jury and truck accident settlement awarded by Harris County District Court, the verdict awards the family more than $89.5 million for damages. The damages include mental anguish, future medical expenses, and physical pain and suffering. No punitive damages were awarded, however.

According to Law360, Zack B., 7, died in the crash, and Brianna B. was left quadriplegic by the trucking accident. According to the truck accident settlement, she will require 24-hour care services for the rest of her life.

The truck accident settlement stems from a lawsuit filed against the company for a Interstate Highway 20 collision back in 2014. According to the family, what led to the collision was careless consideration by the truck driver for the freezing rain and black ice on the road that day.

The family says that the student driver from the company, Shiraz A., averaged a driving speed of 60 miles per hour during the icy conditions prior to the truck accident. The student driver failed to have “access to basic safety equipment like a temperature gauge or radio that would have alerted him to the dangerous road conditions.” What the driver needed to do was get off the road or slow to a crawl, alleged the family in their lawsuit against the trucking company.

The lawyer for the family noted that the verdict for the truck accident settlement should send a message to the company that its safety standards need to be drastically altered. According to the lawyer, although Werner is one of the largest trucking companies in the U.S., it has an “amazingly poor” set of safety policies.

The attorney also said that Werner believes that the company did nothing wrong and that no plans are currently being placed to change safety standards.

“I think they got disgusted with it,” the attorney reported to Law360. “What was striking to me was the arrogance of this trucking company to come in there and take the positions they did.”

The executive vice president and chief legal officer for Werner told Law360 that the accident “unquestionably had tragic results.” The executive extended the thoughts and prayers of the company to the family.

“However, Werner Enterprises maintains that its drivers and the company did not cause this accident,” he added. “While Werner absolutely respects the jury system, we are surprised and extremely disappointed by the jury’s decision in this case, and we will be pursuing an appead of the verdict.”

He also stated in the email to Law360 that the driver was driving “well below the posted speed limit.” And in fact, stated the email, the driver did not lose control of the truck but it was the family’s vehicle which lose control and the side of the driveway it was driving on. The vehicle lost controlled and crossed a grass median and collided with the Werner truck.
