The company that owns Hustler Hollywood has agreed to pay $750,000 to settle class action lawsuit claims that consumers’ privacy rights under the federal Fair and Accurate Credit Transactions Act (FACTA) were violated.

Hustler Hollywood customers who were provided a receipt that displayed more than the last five digits of the card’s account number and/or the expiration date of the card between April 18, 2015 and Feb. 26, 2018 may be eligible for benefits from the FACTA class action settlement.

Lead plaintiff Wade Glenn Whitworth, Jr. alleged in his class action lawsuit that HH-Entertainment Inc. used credit and debit card receipts that displayed more than the last five digits of the card’s account number and/or expiration date. HH-Entertainment owns a chain of adult stores called Hustler Hollywood.

FACTA prohibits companies from printing anything but the last five digits of a credit or debit card number on customer receipts. The law was enacted to help protect consumers from identity theft or credit card fraud in 2003. Merchants had a grace period to get their cash registers and kiosks up to date, but should have become compliant by 2006.

Under FACTA, receipts can contain symbols, such as “#” or “*”, in place of the account numbers, but can only print the last five digits of the account number on the receipt. Customers who discover that their credit or debit card information was exposed by a merchant in violation of FACTA can recover damages by filing a lawsuit.

While HH-Entertainment admits no liability under the terms of the class action settlement, the company has agreed pay a Class of consumers who used a debit or credit card at Hustler Hollywood locations and were given a receipt that violated FACTA laws.

The deadline to opt out of or object to the Hustler Hollywood class action settlement is June 6, 2018.

Who’s Eligible

Class Members include all “persons within the United States who (1) used a credit or debit card; (2) for a transaction at one of Defendant’s retail locations; and (3) were provided a point of sale receipt that displayed more than the last 5 digits of the card’s account number and/or the expiration date of the card; (4) from April 18, 2015 to and including the date of preliminary approval of the class action settlement.”

Potential Award

The settlement fund will be distributed equally to everyone who submits a valid and timely Claim Form.

Proof of Purchase

Class Members are required to fill out the Affidavit Form and submit it by mail in order to benefit from this settlement.
