Upset confused young woman suing mobile phone reading text messageTop Class Actions viewers have reportedly started to receive checks in the mail for up to $100 as a part of the Peak Campus unwanted texts class action settlement.

In his text spam class action lawsuit, lead plaintiff William Truong claimed that Peak Campus Management LLC and ICIM Corp. sent unauthorized text messages in violation of the Telephone Consumer Protection Act (TCPA). Truong filed the class action lawsuit on July 25, 2016, in the Circuit Court of Cook County, Illinois.

The TCPA was passed in 1991 to protect consumers from annoying telemarketers and other solicitors who do not have permission to contact them. The TCPA prohibits businesses from calling before 8 a.m. or after 9 p.m., calling consumers who have specifically asked them to stop, calling consumers on the National Do Not Call Registry, failing to identify who is making the call and their contact information, using an artificial voice, using an automated dialing machine, making robocalls, or sending unsolicited advertising faxes.

Robocalls are any phone call made using an automatic dialing system, a software that dials phone numbers without human intervention. Robocalls also include calls that contain a pre-recorded message or artificial voice. The Federal Communications Commission (FCC) has interpreted robocalls to include text messages.

Peak allegedly sent text messages advertising available commercial properties to tenants of other Peak and ICIM properties. The text messages were allegedly sent without consent. Peak and ICIM both denied liability and any wrongdoing but agreed to settle the complaint to avoid further litigation.

They also agreed to change certain policies going forward by making it easier for tenants to opt out of text messages if they are the unintended recipient. The settlement was granted preliminary approval on Oct. 16, 2017.

People who received an unauthorized text message advertising commercial property from Peak Campus Management or ICIM between July 2012 and Oct. 16, 2017 were eligible for payment from the TCPA class action settlement up to $100.

Claimants had to identify which Peak Property they were a tenant of and provide the telephone number that received the unauthorized text message. The final hearing was Jan. 24, 2018.
