A $7 million settlement has been reached in a class action lawsuit alleging Peak Campus Management LLC and ICIM Corp. violated the Telephone Consumer Protection Act by sending text messages to tenants without prior express invitation or permission. The class action lawsuit was filed on July 25, 2016 in the Circuit Court of Cook County, Illinois.
Plaintiff William Truong alleges that beginning in July 2012, Peak sent text messages advertising commercial property availability, to which he did not consent. According to the Peak Campus Management class action lawsuit, the defendants violated the TCPA by sending unauthorized text messages to tenants at Peak and ICIM properties.
Peak and ICIM denied liability and any wrongdoing, but agreed to a settlement to avoid further litigation. The defendants also agreed to change certain procedures moving forward, by making it easier for tenants who receive text messages to opt out of receiving any further messages, if they are the unintended recipient of the texts.
If you received an unauthorized text message advertising commercial property from Peak Campus Management or ICIM between July 2012 and Oct. 16, 2017, you may be entitled to payment from the TCPA class action settlement. Claimants must identify the Peak Property at which they are, or were a tenant, and provide the number at which the text message was received. Class Members who submit a valid Claim Form will be entitled to a pro rata payment of up to $100.
The Peak Campus Management text message TCPA class action settlement was granted preliminary approval on Oct. 16, 2017. Class Members have until Jan. 4, 2018 to object or opt out of the settlement.
Who’s Eligible
Persons that, at any time between July 2012 and Oct. 16, 2017, received a text message from Peak Campus Management or ICIM Corp. related to the commercial availability of property to which they did not consent.
Potential Award
Up to $100.
Class Members who file a valid claim will get an equal share of the settlement fund, up to $100. However, the actual payment may be less than $100 depending on the total number of claims filed.
Proof of Purchase
Claimants must identify the Peak Property at which they are or were a tenant, and also provide the telephone number that received the unauthorized text message.
