A nearly $1 million settlement has been reached in a class action lawsuit alleging Orbit Baby Inc. and The ERGO Baby Carrier Inc. made deceptive representations that their infant and car seat products are free of certain types of chemicals.
If you purchased a new Orbit Baby infant or toddler seat between April 26, 2012 and Feb. 23, 2018 while you lived in California, you may be entitled to a cash refund from the car seat class action settlement.
Plaintiff Jordana Lee Kopin accuses the defendants of making deceptive and misleading representations about Orbit Baby car seat products, including certain stroller systems, car seats, bassinets, travel systems and certain individual components or accessories for the products.
According to the Orbit Baby car seat class action lawsuit, which Kopin filed in April 2016, the defendants made misleading representations that their products were free of certain unsafe chemicals such as brominated and chlorinated flame retardants.
The Orbit Baby class action lawsuit asserted claims for violations of California law, including California’s Song-Beverly Warranty Act and Consumer Legal Remedies Act.
Orbit Baby and ERGO deny any wrongdoing but agreed to pay $995,000 to settle the car seat class action lawsuit to avoid the time, burden and expense of ongoing litigation.
The Orbit Baby class action settlement was preliminarily approved on Feb. 23, 2018.
Class Members who would like to opt out of or object to the Orbit Baby car seat settlement must do so no later than May 7, 2018.
Who’s Eligible
Class Members of the Orbit Baby settlement include anyone who purchased a new Orbit Baby infant or toddler car seat between April 26, 2012 and Feb. 23, 2018 while they were residing in California, and who have not yet received a full monetary refund from Orbit Baby for their qualified purchase(s).
Potential Award
To be determined. Class Members who submit timely and valid claims will be entitled to a pro rata share of the net settlement fund based on the total number of eligible Orbit Baby car seats you purchased during the Class Period.
Proof of Purchase
Class Members who did not receive official notice of the class action settlement must submit proof of purchase such as a receipt for each purchase of an Orbit Baby infant and/or toddler car seat.

I had a hard time making a cliam.i got my g3 infant car seat plus car seat base as a gift from a friend who lived out of town at my baby shower. I tired to put I claim which was going nowhere. I didn’t have a receipt.no proof of purchase.o explain to my friend about the claim which made things very hard from then on. There’s no way of getting the receipt I didn’t buy it no proof. What can I do I still have it in a box never open and I want my claim.Can anybody help me and give me some helpful tips thanks you.
