Tristar exploding pressure cooker

A class action settlement is now providing owners of allegedly defective Tristar power pressure cookers with warranty extensions and credits toward purchases of new products.

This power pressure cooker settlement resolves claims from two different pressure cooker class action lawsuits. Plaintiff Edwina Pinon filed the first of these actions in March 2016 in a federal court in California. Two months later, plaintiffs Kenneth Chapman, Jessica Vennel, and Jason Jackson brought a similar action in Ohio.

According to the plaintiffs, several models of Tristar-made pressure cookers are defective in ways that create unreasonable dangers for anyone who uses them. Some cookers’ lids release steam suddenly while the lid is being opened, the plaintiffs say.

Other cookers have lids that allegedly fail to stay in place while the device is under pressure, contrary to the manual’s warranty that the lid should not be removable while there is any pressure inside the cooker.

Still other cookers allegedly have defective pressure relief valves or gaskets, that may allow pressure to build up inside the cooker while the lid isn’t properly sealed.

Plaintiffs in the Ohio action won class certification in June 2017. Pinon’s action was transferred to Ohio in October 2017 so the two power pressure cooker class action lawsuits could be handled together. Trial had begun and the plaintiffs had presented part of their case in chief when the parties put trial on hold and worked out this settlement agreement.

Under terms of the power pressure cooker class action settlement, Tristar offers Class Members a warranty extension on whatever qualifying power pressure cooker they already own. Class Members can also get a credit toward the purchase of their choice of three new power kitchen appliances.

When submitting a claim, Class Members must certify that they have watched (or read the transcript of) a three-minute power pressure cooker safety video, available on the settlement website.

Tristar maintains that it has complied with all applicable laws and denied the plaintiffs’ claims. The company says it agreed to this power pressure cooker class action settlement solely to avoid the expense and risks that would come from prolonging the litigation.

Class Members can object to the settlement or opt out of it by submitting a written request no later than June 4, 2018.

Who’s Eligible

The settlement Class covers all U.S. persons who between March 1, 2013 and Jan. 19, 2018 purchased power pressure cookers manufactured or marketed by Tristar.

Potential Award

$72.50 Credit.

Class Members can get a $72.50 credit toward the purchase of their choice of the following new kitchen appliances:

  • Power Cooker, a 10 qt. pressure cooker – Model No. PC-WAL4
  • Power Air Fryer XL, a 5.3 qt. air fryer – Model No. AF-530
  • Copper Chef XL Precision Induction Cooktop Set

Class Members can also get a free extension of their warranty through one year after the effective date of the settlement. The effective date will not be set until the court has granted final approval of the settlement and all opportunities for appeals have been exhausted.

Proof of Purchase

Class Members who received an emailed or mailed notice are asked to present the Class Member ID number that appears in the notice.

Class Members who did not receive a notice can still file a claim. They will be asked for the date and location of their power pressure cooker purchase, the model number, and the name of the pressure cooker on the faceplate. Class Members must also submit proof of purchase, in the form of a receipt, invoice, or photograph of the manufacturer’s identification plate from the bottom of the cooker.

UPDATE 3: On Feb. 4, 2019, the Tristar pressure cooker class action settlement faced pushback from the U.S. Department of Justice (DOJ) that says Class Members get nothing of value from the deal.

    Got my settlement.
    Does anyone know if it’s officially settled or are they still waiting on the ruling that the judge didn’t think we were getting anything of value ?

    Just curious, don’t want to use the voucher Incase it really HASNT been decided yet, & Tristar mailed these out hoping that ppl WILL use them, meaning they accept the settlement so if a judge DOES agree we should get more the ppl that already cashed theirs in won’t get it because they accepted the 72.50.

    This is ridiculous! I got my offer today! Great just want I wanted an opportunity to buy another defective pot at a discounted price! Just send me the check I would be impressed then. I think they got away with fraud!

      Did any of you read the class action prior to submitting your claims? It clearly states you will receive a voucher not a check.

    What a joke…..just got mine in the mail and everything they give you a voucher for has to be purchased from their site at 129.99$ to 149.99$ . All the products they offer are sold at other top retail sites for $59.99 to 89.99$. So not only did they get by with a faulty product , they got by on the settlement too!

        It’s the original settlement so it’s the $72.50 credit and cheapest item is $129.99, so your paying $60+ out of pocket to use it. That’s why they where trying to fight it

    At least the DOJ realizes that giving us an amt that’s only good toward more Tristar items & the amt they want to give (72.50) is only abt 1/2 of what’s needed for the items to be purchased, they aren’t “giving” us ANYTHING, their just wanting to sell us the specified items at a wholesale price!

        I just wish we all were getting a ck for what we paid for theses presume cookers. I paid $110 for mine. Instead of this $72.50 credit toward on of the three items they mention. As the presure cooker PC-WAL4 is one mentioned for the lawsuit. Myself I alreasy have a air fryer and I don’t need any copper chef sets. Please don’t get me wrong as i just would like to have a different cooker brand of my choice. As I’m someone that if I have issues with a brand I will not buy another as might have same issues again. Plus seeing how many people in this case well it would just make you not go back to the same brand. I just want another pressure cooker of my choice. Again please don’t take me wrong in what I’m saying or feeling.

          Dept of justice DIDNT feel this settlement is fair to Tristar customers so they are pushing Tristar to do better.
          Basically the DOJ is saying we aren’t GETTING anything in this settlement, but Tristar is making out better in this deal than the customers who have their products-and were supposedly the “winners” of the lawsuit!

        Morning Hazel. This is very upsetting to read what you found out. All of us basically got took by Tristar on a product that we all purchased that we expected to be a good and safe product. I paid $100 for mine and I’m sure rest of you did to. This isent fair that Tristar wins this. They need to stand behind their mistake and pay out their faulty product . Please Hazel if you hear more let us all know
